Terms Used In Kansas Statutes 16-1308

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Retailer: means any person, partnership, firm, corporation, association, or other form of business enterprise engaged in the business of:

    (1) Selling or leasing outdoor power equipment to the ultimate consumer thereof; and

    (2) repairing or servicing outdoor power equipment. See Kansas Statutes 16-1302

  • Supplier: means any person, partnership, corporation, association, or any and all other forms of business enterprise engaged in the business of manufacturing, assembly or wholesale distribution of outdoor power equipment. See Kansas Statutes 16-1302

If any supplier violates any provisions of Kan. Stat. Ann. §§ 16-1306 or 16-1307, a retailer may bring an action in any court of competent jurisdiction for damages sustained by the retailer as a consequence of the supplier’s violation. The court may also award court costs and reasonable attorney fees to the prevailing party. The remedies set forth in this section shall not be deemed exclusive and shall be in addition to any other remedies permitted by law including proceedings under the Kansas consumer protection act.
