Terms Used In Kansas Statutes 40-2223

  • Commissioner: means the commissioner of insurance. See Kansas Statutes 40-2227
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201

Any person or entity unable to show under Kan. Stat. Ann. § 40-2222 that it is subject to the jurisdiction of an agency of this state or the federal government shall: (a) Submit to an examination by the insurance commissioner to determine the organization and solvency of the person or the entity; (b) be subject to all applicable provisions ofchapter 40 of the Kansas Statutes Annotated. Any examination conducted under this section shall be performed in accordance with Kan. Stat. Ann. §§ 40-222 and 40-223, and amendments thereto.
