Terms Used In Kansas Statutes 40-3810

  • Act: means the pharmacy benefits manager licensure act. See Kansas Statutes 40-3822
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Commissioner: means the commissioner of insurance of the state of Kansas. See Kansas Statutes 40-3801
  • Contract: A legal written agreement that becomes binding when signed.
  • insurer: means a licensed insurance company, hospital or professional service corporation or a managed care organization. See Kansas Statutes 40-3801
  • Person: means an individual or a business entity. See Kansas Statutes 40-3801
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201

A person who is not required to be licensed as an administrator under this act and who directly or indirectly underwrites, collects charges or premiums from or adjusts or settles claims on residents of this state only in connection with life, annuity or health coverage provided by a self-funded plan other than a governmental or church plan, shall register with the commissioner annually, verifying its status as herein described. This section shall not apply to an insurer or to an individual performing these actions as an employee of an insurer. This section shall also not apply to a person performing these actions under contract to or as an employee of an administrator.
