Terms Used In Louisiana Revised Statutes 10:9-710

  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.

(a)  “Former Chapter 9.” In this Part, “former Chapter 9” means Chapter 9 of Revised Statutes Title 10 that was in effect prior to July 1, 2001.

(b)  “Pre-effective-date financing statement.”  In this Part, “pre-effective-date financing statement” means a financing statement filed before July 1, 2001.  The term includes financing statements and continuation statements filed in the office specified in La. Rev. Stat. 10:9-501 under the former Louisiana Assignment of Accounts Receivable Act (La. Rev. Stat. 9:3101 et seq.) and former La. Rev. Stat. 9:5351 through 5366.2 and La. Rev. Stat. 9:5367 through 5373 (Louisiana chattel mortgage statutes).

(c)  Continuation statements under former laws.  Continuation statements described in Subsection (b) shall not be rendered ineffective by this Chapter, nor be found to fail to satisfy the applicable requirements for perfection under La. Rev. Stat. 10:9-705(c), for lack of signature by the debtor.  Continuation statements described in Subsection (b) satisfying the applicable requirements for perfection under law other than former Chapter 9 in effect before July 1, 2001, are effective pre-effective date financing statements under La. Rev. Stat. 10:9-705(c).
