§ 404-c. Ultraviolet nail drying devices. 1. "Ultraviolet nail drying device" shall mean any equipment which is designed to emit electromagnetic radiation in the wavelength interval of two hundred to four hundred nanometers in air, and which is intended to induce nail curing or hardening through irradiation.

  • Appearance enhancement business: means the business of providing any or all of the services licensed pursuant to this article at a fixed location. See N.Y. General Business Law 400
  • Department: means the department of state. See N.Y. General Business Law 400
  • Licensee: means a person licensed pursuant to this article to engage in the practice of natural hair styling, esthetics, nail specialty or cosmetology, or to operate an appearance enhancement business in which such practice, as herein defined, is provided to the public. See N.Y. General Business Law 400
  • nail specialty: means providing services for a fee or any consideration or exchange to cut, shape or to enhance the appearance of the nails of the hands or feet. See N.Y. General Business Law 400

2. If the commissioner of health makes a determination pursuant to § 3556 of the public health law that ultraviolet nail drying devices pose a health hazard to users, any appearance enhancement business where the practice of nail specialty is conducted shall prominently post the notice developed by the department regarding such health hazard in an area clearly visible to patrons in the licensed appearance enhancement business where the practice of nail specialty is conducted or in the place where the practice of nail specialty licensed pursuant to this article is conducted. The department shall develop and make such sign available to each licensee.

3. If the commissioner of health makes a determination pursuant to § 3556 of the public health law that ultraviolet nail drying devices pose a health hazard to users, any appearance enhancement business that utilizes such devices shall comply with any and all regulations adopted by the department pursuant to this article.
