Terms Used In South Carolina Code 15-33-135

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
In any civil action where punitive damages are claimed, the plaintiff has the burden of proving such damages by clear and convincing evidence.
