After July 1, 1994, no individual or underground installation company may install an underground storage tank without having a valid underground storage tank installation company permit. |
Terms Used In Utah Code 19-6-416.5
- Director: means the director of the Division of Environmental Response and Remediation. See Utah Code 19-6-402
- Person: means an individual, trust, firm, estate, company, corporation, partnership, association, state, state or federal agency or entity, municipality, commission, or political subdivision of a state. See Utah Code 19-1-103
- Underground storage tank: means a tank regulated under Subtitle I, Resource Conservation and Recovery Act, 42 U. See Utah Code 19-6-402
- Underground storage tank installation company: means a person, firm, partnership, corporation, governmental entity, association, or other organization that installs underground storage tanks. See Utah Code 19-6-402

Any individual or underground storage tank installation company who installs an underground storage tank in violation of Subsection (1) is subject to a civil penalty of $500 per underground storage tank. |

The director shall issue a notice of agency action assessing a civil penalty of $500 against any underground storage tank installation company or person who installs an underground storage tank in violation of Subsection (1). |
