Sec. 21. (a) This section applies in addition to or instead of any other civil or criminal penalty.
(c) Each:
(b) The department may revoke or suspend the license of a distributor, a stamping agent, or any other person that violates section 15 of this chapter.
Terms Used In Indiana Code 24-3-5.4-21
- commission: means the alcohol and tobacco commission created by Indiana Code 24-3-5.4-3
- department: means the department of state revenue. See Indiana Code 24-3-5.4-4
- distributor: means a person that:

- stamping agent: means a person that may affix a stamp to a package of cigarettes under IC 6-7-1-15. See Indiana Code 24-3-5.4-10
(1) stamp affixed;
(2) sale of cigarettes; or
(3) offer or possession of cigarettes for sale;
in violation of section 15 of this chapter constitutes a separate violation.
(d) The department or the commission may impose a civil penalty that does not exceed the greater of:
(1) five hundred percent (500%) of the retail value of the cigarettes sold; or
(2) five thousand dollars ($5,000);
for each violation of section 15 of this chapter.
