Hawaii Revised Statutes 124B-239 – Process of military courts

(a) Military courts may issue any process or mandate necessary to carry into effect their powers. Military courts may issue subpoenas and subpoenas duces tecum and enforce by attachment attendance of witnesses and production of books and records, when it is sitting within the State and the witnesses, books, and records sought are also located in the State.

Terms Used In Hawaii Revised Statutes 124B-239

Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
Military: refers to any or all of the armed forces. See Hawaii Revised Statutes 124B-1
Military court: means a court-martial or court of inquiry. See Hawaii Revised Statutes 124B-1
Officer: means a commissioned officer. See Hawaii Revised Statutes 124B-1
President: means the detailed member senior in rank of a court-martial then serving. See Hawaii Revised Statutes 124B-1

(b) Process and mandates may be issued by summary courts-martial, military judges, or the president of other military courts and may be directed to and may be executed by the marshals of the military court or any peace officer and shall be in a form as prescribed by rules adopted under this chapter.

(c) All officers to whom process or mandates are directed shall execute them and make return of their acts thereunder according to the requirements of those documents. Except as otherwise specifically provided in this chapter, no officer shall demand or require payment of any fee or charge for receiving, executing, or returning a process or mandate or for any service in connection therewith.
