Terms Used In Texas Estates Code 258.052

  • Court: means and includes:
    (1) a county court in the exercise of its probate jurisdiction;
    (2) a court created by statute and authorized to exercise original probate jurisdiction; and
    (3) a district court exercising original probate jurisdiction in a contested matter. See Texas Estates Code 22.007
  • Probate: Proving a will
  • Testator: A male person who leaves a will at death.

If an applicant described by § 258.051(a) cannot, with reasonable diligence, ascertain the address of any of the testator‘s heirs, the court shall appoint an attorney ad litem to protect the interests of the testator’s unknown heirs after an application for the probate of a will is made under § 256.003(a).
