Paternity

Paternity laws involve the legal relationship between a father and a child. A child’s paternity may relate to issues of legitimacy, inheritance, rights to a surname, rights to custody and obligations for child support. A child born to a married woman during a marriage is presumed under common law to be the child of her husband but these presumptions can be rebutted by evidence to the contrary. Unwed fathers may come forward and accept the paternity of his child. Paternity testing may be used when there is a dispute about biological paternity.
