Terms Used In Utah Code 76-8-705
- Actor: means a person whose criminal responsibility is in issue in a criminal action. See Utah Code 76-1-101.5
- Property: includes both real and personal property. See Utah Code 68-3-12.5
(1)(a) As used in this section, “institution” means the same as that term is defined in Section 53B-20-107 .
(1)(b) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.
(2) An actor commits willful interference with lawful activities of students or faculty if the actor, while on property that is owned, operated, or controlled by an institution, willfully:
(2)(a) denies to a student, school official, employee, or invitee lawful:
(2)(a)(i) freedom of movement;
(2)(a)(ii) use of the property or facilities; or
(2)(a)(iii) ingress or egress to the institution’s physical facilities;
(2)(b) impedes a faculty or staff member of the institution in the lawful performance of the member’s duties; or
(2)(c) impedes a student of the institution in the lawful pursuit of the student’s educational activities.
(3) A violation of Subsection (2) is a class C misdemeanor.
