Sec. 17. If a holder disputes the attorney general’s right to custody of unclaimed property, the attorney general has the burden to prove:

(1) the existence and amount of the property;

Terms Used In Indiana Code 32-34-1.5-17

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
(2) the property is presumed abandoned; and

(3) the property is subject to the custody of the attorney general.
