Terms Used In 50 CFR Part 665

  • Act: means the Deepwater Port Act of 1974, as amended (codified at 33 U. See 33 CFR 148.5
  • Adjacent Coastal State: means any coastal State which:

    (1) Would be directly connected by pipeline to a deepwater port, as proposed in an application. See 33 CFR 148.5

  • Affiliate: means a person:

    (1) That has a direct or indirect ownership interest of more than 3 percent in an applicant. See 33 CFR 148.5

  • American Samoa FEP: means the Fishery Ecosystem Plan for American Samoa, available from the Western Pacific Fishery Management Council or PIRO. See 50 CFR 665.12
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicant: means a person that is the owner of a proposed deepwater port and is applying for a license under this part for that port. See 33 CFR 148.5
  • Application: means an application submitted under this part for a license to own, construct, and operate a deepwater port. See 33 CFR 148.5
  • Approval series: means the first six digits of a number assigned by the Coast Guard to approved equipment. See 33 CFR 148.5
  • Approved: means approved by the Commandant (CG-5P). See 33 CFR 148.5
  • Bequest: Property gifted by will.
  • Carapace length: means a measurement in a straight line from the ridge between the two largest spines above the eyes, back to the rear edge of the carapace of a spiny lobster (see Figure 1 to this part). See 50 CFR 665.12
  • Chambers: A judge's office.
  • Circle hook: means a fishing hook with the point turned perpendicularly back towards the shank. See 50 CFR 665.12
  • Coastal environment: means the coastal waters including the lands in and under those waters, internal waters, and the adjacent shorelines including waters in and under those shorelines. See 33 CFR 148.5
  • Coastal State: means a State of the United States in or bordering the Atlantic, Pacific, or Arctic Oceans or the Gulf of Mexico. See 33 CFR 148.5
  • Commandant: means the Commandant of the U. See 33 CFR 127.005
  • Commercial fishing: means fishing in which the fish harvested, either in whole or in part, are intended to enter commerce or enter commerce through sale, barter, or trade. See 50 CFR 665.12
  • Construction: means supervising, inspecting, actual building, and all other activities incidental to the building, repairing, or expanding of a deepwater port or any of its components. See 33 CFR 148.5
  • Control: means the direct or indirect power to determine the policy, business practices, or decisionmaking process of another person, whether by stock or other ownership interest, by representation on a board of directors or similar body, by contract or other agreement with stockholders or others, or otherwise. See 33 CFR 148.5
  • Control room: means a space within the LNG waterfront facility from which facility operations are controlled. See 33 CFR 127.005
  • Council: means the Western Pacific Fishery Management Council. See 50 CFR 665.12
  • Customary exchange: means the non-market exchange of marine resources between fishermen and community residents, including family and friends of community residents, for goods, and/or services for cultural, social, or religious reasons. See 50 CFR 665.12
  • Dead coral: means any precious coral that no longer has any live coral polyps or tissue. See 50 CFR 665.12
  • EFP: means an experimental fishing permit. See 50 CFR 665.12
  • Facility: means either a waterfront facility handling LHG or a waterfront facility handling LNG. See 33 CFR 127.005
  • Fishing trip: means a period of time during which fishing is conducted, beginning when the vessel leaves port and ending when the vessel lands fish. See 50 CFR 665.12
  • Fishing year: means the year beginning at 0001 local time on January 1 and ending at 2400 local time on December 31, with the exception of fishing for Deep 7 bottomfish and any precious coral MUS. See 50 CFR 665.12
  • Flammable product: means a product indicated by the letter "F" or by the letters "F + T" in Table 127. See 33 CFR 127.005
  • Freeboard: means the straight line vertical distance between a vessel's working deck and the sea surface. See 50 CFR 665.12
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governor: means the governor of a State or the person designated by State law to exercise the powers granted to the governor under the Act. See 33 CFR 148.5
  • Harvest guideline: means a specified numerical harvest objective. See 50 CFR 665.12
  • Hawaii FEP: means the Fishery Ecosystem Plan for the Hawaiian Archipelago, available from the Western Pacific Fishery Management Council or PIRO. See 50 CFR 665.12
  • Hawaiian Archipelago: means the Main and Northwestern Hawaiian Islands, including Midway Atoll. See 50 CFR 665.12
  • Impounding space: means a space formed by dikes and floors that confines a spill of LHG or LNG. See 33 CFR 127.005
  • Intestate: Dying without leaving a will.
  • LHG: means liquefied hazardous gas. See 33 CFR 127.005
  • LHG vessel: means a vessel constructed or converted to carry LHG, in bulk. See 33 CFR 127.005
  • License: means a license issued under this part to own, construct, and operate a deepwater port. See 33 CFR 148.5
  • Live coral: means any precious coral that has live coral polyps or tissue. See 50 CFR 665.12
  • Live rock: means any natural, hard substrate, including dead coral or rock, to which is attached, or which supports, any living marine life form associated with coral reefs. See 50 CFR 665.12
  • LNG: means liquefied natural gas. See 33 CFR 127.005
  • LNG vessel: means a vessel constructed or converted to carry LNG, in bulk. See 33 CFR 127.005
  • Loading flange: means the connection or group of connections in the cargo transfer pipeline on the facility that connects the facility pipeline to the vessel pipeline. See 33 CFR 127.005
  • MARAD: means the Administrator of the Maritime Administration or that person's designees, and includes the Associate Administrator, Port, Intermodal and Environmental Activities, Maritime Administration, or that individual's authorized representative, at 400 Seventh Street, SW. See 33 CFR 148.5
  • Mariana Archipelago: means Guam and the Northern Mariana Islands. See 50 CFR 665.12
  • Mating flange: means that flange in the product-transfer pipeline on a waterfront facility handling LHG or a waterfront facility handling LNG that connects this pipeline to the pipeline or transfer hose of the vessel. See 33 CFR 127.005
  • MAWP: means maximum allowable working pressure. See 33 CFR 127.005
  • Monument: means the submerged lands and, where applicable, waters of the Marianas Trench Marine National Monument as defined in §665. See 50 CFR 665.902
  • Monument: means the waters and submerged and emergent lands of the Pacific Remote Islands Marine National Monument and the Pacific Remote Islands Marine National Monument Expansion, as defined in §665. See 50 CFR 665.932
  • Monument: means the waters and emergent and submerged lands of the Rose Atoll Marine National Monument, as defined in §665. See 50 CFR 665.962
  • Natural gas: means either natural gas, unmixed, or any mixture of natural or artificial gas, including compressed or liquefied natural gas. See 33 CFR 148.5
  • Non-commercial fishing: means fishing that does not meet the definition of commercial fishing in the Magnuson-Stevens Fishery Conservation and Management Act, and includes, but is not limited to, sustenance, subsistence, traditional indigenous, and recreational fishing. See 50 CFR 665.12
  • Offload: means to remove MUS or ECS from a vessel. See 50 CFR 665.12
  • Oil: means petroleum, crude oil, and any substance refined from petroleum or crude oil. See 33 CFR 148.5
  • Operator: means the person who is licensed under 33 U. See 33 CFR 148.5
  • Pelagics FEP: means the Fishery Ecosystem Plan for Pelagic Fisheries of the Western Pacific, available from the Western Pacific Fishery Management Council or PIRO. See 50 CFR 665.12
  • Person: means an individual, a public or private corporation, a partnership or other association, or a government entity. See 33 CFR 148.5
  • Personnel: means individuals who are employed by licensees, operators, contractors, or subcontractors, and who are on a deepwater port because of their employment. See 33 CFR 148.5
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Proclamation: means Presidential Proclamation 8335 of January 6, 2009, "Establishment of the Marianas Trench Marine National Monument. See 50 CFR 665.902
  • Proclamation: means Presidential Proclamation 8337 of January 6, 2009, "Establishment of the Rose Atoll Marine National Monument. See 50 CFR 665.962
  • Proclamations: means Presidential Proclamation 8336 of January 6, 2009, "Establishment of the Pacific Remote Islands Marine National Monument" and Presidential Proclamation 9173 of September 29, 2014, "Pacific Remote Islands Marine National Monument Expansion. See 50 CFR 665.932
  • Protected species: means an animal protected under the MMPA, as amended, listed under the ESA, as amended, or subject to the Migratory Bird Treaty Act, as amended. See 50 CFR 665.12
  • Receiving vessel: means a vessel that receives fish or fish products from a fishing vessel, and with regard to a vessel holding a permit under §665. See 50 CFR 665.12
  • Recreational fishing: means fishing conducted for sport or pleasure, including charter fishing. See 50 CFR 665.12
  • Regional Administrator: means Regional Administrator, Pacific Islands Region, NMFS (see Table 1 of §600. See 50 CFR 665.12
  • Release: means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment, except a minor release of LHG or its vapor, that may occur during the routine handling of LHG. See 33 CFR 127.005
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Selective gear: means any gear used for harvesting coral that can discriminate or differentiate between type, size, quality, or characteristics of living or dead coral. See 50 CFR 665.12
  • Special permit: means a permit issued to allow fishing for coral reef ECS in low-use MPAs or with any gear not specifically allowed under §665. See 50 CFR 665.12
  • SSC: means the Scientific and Statistical Committee of the Western Pacific Fishery Management Council. See 50 CFR 665.12
  • State: includes each State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and the territories and possessions of the United States. See 33 CFR 148.5
  • Substructure: means the deck of a pier or wharf and the structural components below that deck. See 33 CFR 127.005
  • Survival craft: means a craft described in §149. See 33 CFR 148.5
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transship: means to offload or otherwise transfer MUS or ECS or products thereof to a receiving vessel. See 50 CFR 665.12
  • Trap: means a box-like device used for catching and holding lobsters or fish. See 50 CFR 665.12
  • Vessel: means every description of watercraft, including non-displacement craft e. See 33 CFR 148.5
