  • Access: means availability of a record to a subject individual. See 34 CFR 5b.1
  • Act: means the Freedom of Information Act, 5 U. See 22 CFR 1102.2
  • Agency: means the Department of Education. See 34 CFR 5b.1
  • Agency: has the meaning given in 5 U. See 5 CFR 2604.103
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Approval: means a written authorization, including a competent authority approval, issued by the Associate Administrator, the Associate Administrator's designee, or as otherwise prescribed in the HMR, to perform a function for which prior authorization by the Associate Administrator is required under subchapter C of this chapter (49 CFR parts 171 through 180).   • Assistant Attorney General: means the Assistant Attorney General, Civil Rights Division, United States Department of Justice. See 22 CFR 1103.103
  • Associate Administrator: means Associate Administrator for Hazardous Materials Safety, Pipeline and Hazardous Materials Safety Administration. See 49 CFR 105.5
  • Auxiliary aids: means services or devices that enable persons with impaired sensory, manual, or speaking skills to have an equal opportunity to participate in, and enjoy the benefits of, programs or activities conducted by the agency. See 22 CFR 1103.103
  • Commissioner: means head of the United States Section, International Boundary and Water Commission, United States and Mexico. See 22 CFR 1102.2
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Department of Education. See 34 CFR 5b.1
  • Disclosure: means the availability or release of a record to anyone other than the subject individual. See 34 CFR 5b.1
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Duplication: means the process of making a copy of a record. See 5 CFR 2604.103
  • FOIA: means 5 U. See 5 CFR 2604.103
  • FOIA Officer: means the OGE employee designated to handle various initial FOIA matters, including requests and related matters such as fees. See 5 CFR 2604.103
  • FOIA Public Liaison: means the OGE official designated in 5 U. See 5 CFR 2604.103
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Grade: means a class or rank of quality. See 7 CFR 51.2
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Handicapped person: means any person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment. See 22 CFR 1103.103
  • Has a record of such an impairment: means has a history of, or has been misclassified as having, a mental or physical impairment that substantially limits one or more major life activities. See 22 CFR 1103.103
  • Hazardous material: means a substance or material that the Secretary of Transportation has determined is capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and has designated as hazardous under section 5103 of Federal hazardous materials transportation law (49 U. See 49 CFR 105.5
  • HMR: means the regulations at 49 CFR parts 171 through 180. See 49 CFR 105.5
  • Individual: means a living person who is a citizen of the United States or an alien lawfully admitted for permanent residence. See 34 CFR 5b.1
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Maintain: means to maintain, collect, use, or disseminate when used in connection with the term "record". See 34 CFR 5b.1
  • Major life activities: includes functions such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working. See 22 CFR 1103.103
  • Notification: means communication to an individual whether he is a subject individual. See 34 CFR 5b.1
  • Person: means an individual, firm, copartnership, corporation, company, association, or joint-stock association (including any trustee, receiver, assignee, or similar representative). See 49 CFR 105.5
  • Person: has the meaning given in 5 U. See 5 CFR 2604.103
  • Personal property: All property that is not real property.
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Record: means any item, collection, or grouping of information about an individual that is maintained by the Department, including but not limited to the individual's education, financial transactions, medical history, and criminal or employment history and that contains his name, or an identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph. See 34 CFR 5b.1
  • Records: means any handwritten, typed, or printed documents (such as memoranda, books, brochures, studies, writings, drafts, letters, transcripts, and minutes) and documentary material in other forms (such as electronic documents, electronic mail, magnetic tapes, cards or discs, paper tapes, audio or video recordings, maps, photographs, slides, microfilm and motion pictures) that are either created or obtained by OGE and are under its control. See 5 CFR 2604.103
  • Request: means any request for records made pursuant to 5 U. See 5 CFR 2604.103
  • Request: means a letter or other written communication seeking records or information under the Freedom of Information Act. See 22 CFR 1102.2
  • Requester: means any person who makes a request for records to OGE. See 5 CFR 2604.103
  • Requester: includes any individual, firm, corporation, organization or other entity. See 22 CFR 1102.2
  • Review: means the process of initially, or upon appeal (see §2604. See 5 CFR 2604.103
  • Review: refers to the process of examining documents located in response to a request that is for commercial use to determine if any portion of that document is permitted to be withheld, and processing any document for disclosure (i. See 22 CFR 1102.2
  • Routine use: means the disclosure of a record outside the Department, without the consent of the subject individual, for a purpose which is compatible with the purpose for which the record was collected. See 34 CFR 5b.1
  • Sample: means any number of sample units to be used for inspection. See 7 CFR 51.2
  • Search: means the time spent looking for material manually or by automated means that is responsive to a request, including page-by-page or line-by-line identification of material within documents. See 5 CFR 2604.103
  • Search: includes all time spent looking for material that is responsive to a request, including page-by-page or line-by-line identification of material within documents. See 22 CFR 1102.2
  • Secretary: means the Secretary of Education. See 34 CFR 5b.1
  • Service of process: The service of writs or summonses to the appropriate party.
  • Special permit: means a document issued by the Associate Administrator, the Associate Administrator's designee, or as otherwise prescribed in the HMR, under the authority of 49 U. See 49 CFR 105.5
  • State: means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Virgin Islands, American Samoa, Guam, or any other territory or possession of the United States designated by the Secretary. See 49 CFR 105.5
  • Subject individual: means that individual to whom a record pertains. See 34 CFR 5b.1
  • Subpoena: A command to a witness to appear and give testimony.
  • System of records: means any group of records under the control of the Department from which a record is retrieved by personal identifier such as the name of the individual, number, symbol or other unique retriever assigned to the individual. See 34 CFR 5b.1
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transportation: means the movement of property and loading, unloading, or storage incidental to the movement. See 49 CFR 105.5
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Waiver of Preemption: means a decision by the Associate Administrator to forego preemption of a non-Federal requirement--that is, to allow a State, political subdivision or Indian tribe requirement to remain in effect. See 49 CFR 105.5
  • Working days: means calendar days, excepting Saturdays, Sundays, and legal public holidays. See 5 CFR 2604.103
