(a) A student who is not a domiciliary of the state shall be permitted to register to enroll in a public K-12 school by remote means, including electronic means, prior to commencement of the student’s residency in this state if all of the following apply:
Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
state: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Alabama Code 1-1-1
(1) A parent or legal guardian is on active military duty and is transferred or pending transfer to a military installation or reservation in this state.(2) Upon request by the local board of education, a parent or legal guardian provides a copy of the official military order transferring to a military installation or reservation located in this state. (3) A parent or legal guardian completes and submits the board of education’s required enrollment forms and documentation, except that proof of residency shall not be required until the student physically transfers to this state, at which time the student shall be required to provide proof of residency prior to commencing attendance.(b) The local board of education shall make available to a student who registers to enroll pursuant to this section the same opportunities for school assignment and selection of courses and sporting activities as those offered to resident students.
