In granting a permit or variance under section 28-8470 or 28-8471, the administrative agency or board of adjustment, if it deems the action advisable to fulfill the purposes of this article and reasonable in the circumstances, may place a condition on the permit or variance that requires the owner of the structure or tree in question to permit the political subdivision, at its own expense, to install, operate and maintain markers and lights on the structure or tree as necessary to indicate the presence of an airport hazard.

  • Airport: means an area of land or water that is designed and set aside for the landing and taking off of aircraft and that is utilized or to be utilized in the interest of the public for those purposes. See Arizona Laws 28-8461

    (a) A person who holds the legal title of a vehicle. See Arizona Laws 28-101

  • Political subdivision: means a city, town or county and includes a school district. See Arizona Laws 28-8461
  • Structure: means an object that is constructed or installed by a human including a building, tower, smokestack or overhead transmission line. See Arizona Laws 28-8461
  • Tree: means an object of natural growth. See Arizona Laws 28-8461
