A person who is not a resident of this state, domiciled in this state or authorized to do business in this state and who files an application is deemed to have:

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Application: means an application which is made pursuant to this article for approval of the deputy director to become a financial institution holding company. See Arizona Laws 6-1101
  • Deputy director: means the deputy director of the financial institutions division of the department. See Arizona Laws 6-101
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
  • Service of process: The service of writs or summonses to the appropriate party.

1. Consented to the jurisdiction of the courts of this state for all actions arising under this article.

2. Appointed the deputy director as the person’s lawful agent for the purpose of accepting service of process in any action, suit or proceeding that may arise under this article. The deputy director shall transmit copies of all such lawful process accepted by the deputy director as an agent by certified mail to the person at the person’s last known address.
