Terms Used In Arizona Laws > Title 9 > Chapter 13

  • Abortion: means the use of any means to terminate the clinically diagnosable pregnancy of a woman with knowledge that the termination by those means will cause, with reasonable likelihood, the death of the unborn child. See Arizona Laws 36-2151
  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Administration: means the Arizona health care cost containment system administration. See Arizona Laws 36-2021
  • Administrative medical direction: means supervision of emergency medical care technicians by a base hospital medical director, administrative medical director or basic life support medical director. See Arizona Laws 36-2201
  • administrative medical director: means a physician who is licensed pursuant to title 32, chapter 13 or 17 and who provides direction within the emergency medical services and trauma system. See Arizona Laws 36-2201
  • Advance fee: means a fee, interest or other consideration directly or indirectly received by a person prior to a loan of money or extension of credit or a commitment to loan money or extend credit being made by the person. See Arizona Laws 6-1301
  • Advance fee loan broker: means a person who is not exempt under section 6-1302 and who for an advance fee or in the expectation of an advance fee either directly or indirectly makes or procures, attempts to make or procure or offers to make or procure or attempt to make or procure a loan of money or extension of credit. See Arizona Laws 6-1301
  • Advance practice provider: means a physician assistant as defined in section 32-2501 or a registered nurse practitioner as defined in section 32-1601. See Arizona Laws 36-2171
  • Advanced emergency medical technician: means a person who has been trained in an advanced emergency medical technician program certified by the director or in an equivalent training program and who is certified by the director to render services pursuant to section 36-2205. See Arizona Laws 36-2201
  • Advanced life support: means the level of assessment and care identified in the scope of practice approved by the director for the advanced emergency medical technician, emergency medical technician I-99 and paramedic. See Arizona Laws 36-2201
  • Advanced life support base hospital: means a health care institution that offers general medical and surgical services, that is certified by the director as an advanced life support base hospital and that is affiliated by written agreement with a licensed ambulance service, municipal rescue service, fire department, fire district or health services district for medical direction, evaluation and control of emergency medical care technicians. See Arizona Laws 36-2201
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means a person that directly or indirectly, through one or more intermediaries, controls, is controlled by or is under common control with a video service provider. See Arizona Laws 9-1401
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agreement: means any agreement or contract. See Arizona Laws 9-1401
  • Alcoholic: means a person who habitually lacks self-control with respect to the use of alcoholic beverages or who uses alcoholic beverages to the extent that the person's health is substantially impaired or endangered or social or economic functions are substantially disrupted. See Arizona Laws 36-2021
  • Allegation: something that someone says happened.
  • Ambulance: means any publicly or privately owned surface, water or air vehicle, including a helicopter, that contains a stretcher and necessary medical equipment and supplies pursuant to section 36-2202 and that is especially designed and constructed or modified and equipped to be used, maintained or operated primarily for the transportation of individuals who are sick, injured or wounded or who require medical monitoring or aid.   • Ambulance attendant: means any of the following:

    (a) An emergency medical technician, an advanced emergency medical technician, an emergency medical technician I-99 or a paramedic whose primary responsibility is the care of patients in an ambulance and who meets the standards and criteria adopted pursuant to section 36-2204. See Arizona Laws 36-2201

  • Ambulance service: means a person who owns and operates one or more ambulances. See Arizona Laws 36-2201
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved private treatment facility: means a private agency meeting the standards established by the department and approved pursuant to sections 36-2023 and 36-2029. See Arizona Laws 36-2021
  • Approved public treatment facility: means a treatment agency operating under the directions and control of a county, providing treatment through a contract with a county, meeting the standards established by the department and approved pursuant to sections 36-2023 and 36-2029. See Arizona Laws 36-2021
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Auscultation: means the act of listening for sounds made by internal organs of the unborn child, specifically for a heartbeat, using an ultrasound transducer and fetal heart rate monitor. See Arizona Laws 36-2151
  • Authorized delegate: means a person designated by the licensee under section 6-1208. See Arizona Laws 6-1201
  • Automated external defibrillator: means a medical device heart monitor and defibrillator that:

    (a) Is approved for premarket modification by the United States food and drug administration pursuant to 21 United States Code section 360(k). See Arizona Laws 36-2261

  • Bank: means a corporation that holds a banking permit issued pursuant to chapter 2 of this title. See Arizona Laws 6-101
  • Basic life support: means the level of assessment and care identified in the scope of practice approved by the director for the emergency medical responder and emergency medical technician. See Arizona Laws 36-2201
  • Behavioral health provider: means a physician who is a board-certified or board-eligible psychiatrist, a psychologist, a physician assistant or a registered nurse practitioner who is certified to practice as a behavioral health specialist or a person who is licensed pursuant to title 32 as a clinical social worker, professional counselor or marriage and family therapist. See Arizona Laws 36-2171
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the Arizona state board of pharmacy. See Arizona Laws 36-2501
  • boundaries: means all of the area within the corporate limits of the city or town. See Arizona Laws 9-1401
  • Branch: means any banking office other than the principal banking office. See Arizona Laws 6-101
  • Bureau: means the bureau of emergency medical services and trauma system in the department. See Arizona Laws 36-2201
  • Cannabis: means the following substances under whatever names they may be designated:

    (a) Marijuana. See Arizona Laws 36-2501

  • center: means an initial reception agency for a person who is intoxicated or who is incapacitated by alcohol to receive initial evaluation and processing for assignment for further evaluation or into a treatment program. See Arizona Laws 36-2021
  • Centralized medical direction communications center: means a facility that is housed within a hospital, medical center or trauma center or a freestanding communication center that meets the following criteria:

    (a) Has the ability to communicate with ambulance services and emergency medical services providers rendering patient care outside of the hospital setting via radio and telephone. See Arizona Laws 36-2201

  • Certificate of necessity: means a certificate that is issued to an ambulance service by the department and that describes the following:

    (a) Service area. See Arizona Laws 36-2201

  • Certifying organization: means an organization that certifies homes as sober living homes and is affiliated with a national organization recognized by the department whose primary function is to improve access to and the quality of sober living residences through standards, education, research and advocacy. See Arizona Laws 36-2061
  • Chambers: A judge's office.
  • Check: means a draft signed by the maker and made payable to a person that is licensed pursuant to this chapter with the name of the maker preprinted on the face of the check. See Arizona Laws 6-1251
  • Check cashing: means exchanging for compensation a check, debit card payment order, draft, money order, traveler's check or payment instrument of a licensee for money delivered to the presenter at the time and place of the presentation. See Arizona Laws 6-1201
  • Citrus: means varieties of the genus citrus commercially produced in this state for the fresh market but does not include commercially produced by-products or products manufactured for resale. See Arizona Laws 3-468
  • Commercial mobile service provider: means a person that provides commercial mobile service as defined in 47 United States Code section 332(d) or commercial mobile radio service as described in 47 Code of Federal Regulations section 20. See Arizona Laws 9-1401
  • Conception: means the fusion of a human spermatozoon with a human ovum. See Arizona Laws 36-2151
  • Contract: A legal written agreement that becomes binding when signed.
  • Control: means ownership of fifteen per cent or more of a licensee or controlling person, or the power to vote fifteen per cent or more of the outstanding voting securities of a licensee or controlling person. See Arizona Laws 6-1201
  • Controlled substance: means a drug, substance or immediate precursor in schedules I through V of article 2 of this chapter. See Arizona Laws 36-2501
  • Controlling person: means a person directly or indirectly in control of a licensee. See Arizona Laws 6-1201
  • Conviction: A judgement of guilt against a criminal defendant.
  • Coordinating medical provider: means a physician or group of physicians, or any combination thereof, which has entered into an agreement with a county, incorporated city or town, health service district or the department to supervise the medical care offered at a medical clinic, as defined by this section. See Arizona Laws 36-2351
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the emergency medical services council. See Arizona Laws 36-2201
  • Council: means the Arizona citrus research council. See Arizona Laws 3-468
  • Court: means the supreme court, the court of appeals, a superior court, a justice of the peace court, a municipal court or a city court authorized by charter. See Arizona Laws 36-2021
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Day: means a calendar day, except a Saturday or Sunday or a holiday prescribed in section 1-301. See Arizona Laws 9-1401
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Deferred presentment services: means a transaction pursuant to a written agreement in which the licensee accepts a check and agrees to hold the check for at least five days before presentment for payment or deposit. See Arizona Laws 6-1251
  • Defibrillation: means the administration of a controlled electrical charge to the heart to restore a viable cardiac rhythm. See Arizona Laws 36-2261
  • Department: means the department of health services. See Arizona Laws 36-2171
  • Department: means the department of health services. See Arizona Laws 36-2201
  • Department: means the department of health services. See Arizona Laws 36-2351
  • Department: means the department of health services. See Arizona Laws 36-2451
  • Department: means the department of public safety. See Arizona Laws 36-2501
  • Department: means the Arizona department of agriculture. See Arizona Laws 3-468
  • Department: means the department of health services. See Arizona Laws 36-2101
  • Department: means the department of financial institutions. See Arizona Laws 6-101
  • Department: means the department of health services. See Arizona Laws 36-2021
  • Dependent: A person dependent for support upon another.
  • Destructive human embryonic stem cell research: means any research that involves the disaggregation of any human embryo for the purpose of creating human pluripotent stem cells or human pluripotent stem cell lines. See Arizona Laws 36-2311
  • Devise: To gift property by will.
  • Director: means the director of the department of health services. See Arizona Laws 36-2201
  • Director: means the director of the department of health services. See Arizona Laws 36-2451
  • Director: means the director of the department of health services. See Arizona Laws 36-2101
  • Director: means the director of the administration. See Arizona Laws 36-2021
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Drug enforcement administration: means the drug enforcement administration of the department of justice of the United States or its successor agency. See Arizona Laws 36-2501
  • Emergency medical care technician: means an individual who has been certified by the department as an emergency medical technician, an advanced emergency medical technician, an emergency medical technician I-99 or a paramedic. See Arizona Laws 36-2201
  • Emergency medical services: means those services required following an accident or an emergency medical situation:

    (a) For on-site emergency medical care. See Arizona Laws 36-2201

  • Emergency medical services provider: means any governmental entity, quasi-governmental entity or corporation whether public or private that renders emergency medical services in this state. See Arizona Laws 36-2201
  • Emergency medical technician: means a person who has been trained in an emergency medical technician program certified by the director or in an equivalent training program and who is certified by the director as qualified to render services pursuant to section 36-2205. See Arizona Laws 36-2201
  • Emergency receiving facility: means a licensed health care institution that offers emergency medical services, is staffed twenty-four hours a day and has a physician on call. See Arizona Laws 36-2201
  • Engage in the business: means conducting activities regulated under this chapter more than ten times in any calendar year for compensation or in the expectation of compensation. See Arizona Laws 6-1201
  • Enterprise: means any person under the jurisdiction of the department other than a financial institution. See Arizona Laws 6-101
  • Evaluation: means a multidisciplinary professional analysis of a person's medical, psychological, social, financial and legal conditions. See Arizona Laws 36-2021
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal poverty guidelines: means the poverty guidelines as updated annually in the federal register by the United States department of health and human services. See Arizona Laws 1-215
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiduciary: A trustee, executor, or administrator.
  • Financial institution: means banks, trust companies, savings and loan associations, credit unions, consumer lenders, international banking facilities and financial institution holding companies under the jurisdiction of the department. See Arizona Laws 6-101
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fit and proper: means that the director determines that an applicant for a certificate of necessity or a certificate holder has the expertise, integrity, fiscal competence and resources to provide ambulance service in the service area. See Arizona Laws 36-2201
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Foreign money exchange: means exchanging for compensation money of the United States government or a foreign government to or from money of another government at a conspicuously posted exchange rate at the time and place of the presentation of the money to be exchanged. See Arizona Laws 6-1201
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Gestational age: means the age of the unborn child as calculated from the first day of the last menstrual period of the pregnant woman. See Arizona Laws 36-2151
  • Grower-shipper: means a person who is engaged in this state in the business of packing, shipping, transporting or selling citrus of which he is a grower, producer or owner. See Arizona Laws 3-468
  • Handler: means a person who engages in marketing citrus on behalf of a grower, whether as a grower-shipper, owner, agent, employee, broker, dealer, consignor or commission merchant or otherwise. See Arizona Laws 3-468
  • Health care entity: means any of the following:

    (a) A licensed health care provider. See Arizona Laws 36-2401

  • Health service district: means a health service district established pursuant to title 48, chapter 16, article 1. See Arizona Laws 36-2351
  • Highway: means all roads, streets and alleys and other dedicated public rights-of-way that are operated and maintained by a local government. See Arizona Laws 9-1401
  • Holder: means a video service provider that has been issued a uniform video service license pursuant to this chapter. See Arizona Laws 9-1401
  • Holdover cable operator: means an incumbent cable operator that elects under sections 9-1412 and 9-1413 to continue to operate within its service area pursuant to its local license. See Arizona Laws 9-1401
  • Hospital: means a health care institution licensed as a hospital pursuant to chapter 4, article 2 of this title. See Arizona Laws 36-2351
  • Human embryo: means a living organism of the species homo sapiens through the first fifty-six days of its development, excluding any time during which its development has been suspended. See Arizona Laws 36-2311
  • Human-animal hybrid: means any of the following:

    (a) A human embryo into which a nonhuman cell or cells, or any component part of a nonhuman cell or cells, have been introduced. See Arizona Laws 36-2311

  • Immediate precursor: means a substance which the board has found to be and by rule designates as being the principal compound commonly used or produced primarily for use and which is an immediate chemical intermediary used or likely to be used in the manufacture of a controlled substance, the control of which is necessary to prevent, curtail or limit manufacture. See Arizona Laws 36-2501
  • In vitro: means outside the human body. See Arizona Laws 36-2311
  • Incapacitated by alcohol: means that a person as a result of the use of alcohol is unconscious or has judgment otherwise so impaired that the person is incapable of realizing and making a rational decision with respect to the person's need for evaluation and treatment, is unable to take care of basic personal needs or safety such as food, clothing, shelter or medical care or lacks sufficient understanding or capacity to make or communicate rational decisions.   • including: means not limited to and is not a term of exclusion. See Arizona Laws 1-215
  • Incumbent cable operator: means a cable operator or other video service provider that on December 31, 2019 is providing video service in this state pursuant to a local license. See Arizona Laws 9-1401
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intoxicated person: means a person whose mental or physical functioning is substantially impaired as a result of the immediate effects of alcohol in the person's system. See Arizona Laws 36-2021
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a license issued pursuant to this chapter. See Arizona Laws 6-1251
  • License: means a franchise as defined in 47 United States Code section 522. See Arizona Laws 9-1401
  • License fee: means a license fee imposed by a local government on a video service provider for using the highways to provide and for the privilege of providing video service. See Arizona Laws 9-1401
  • Licensed health care provider: means a person or institution that is licensed or certified by this state to provide health care, medical services, nursing services or other health-related services. See Arizona Laws 36-2401
  • Licensee: means a person licensed under this chapter. See Arizona Laws 6-1201
  • Licensee: means a corporation, company, firm, partnership, association or natural person that is licensed by the superintendent to engage in the business of providing deferred presentment services pursuant to this chapter. See Arizona Laws 6-1251
  • Local government: means any city, including a charter city, or town. See Arizona Laws 9-1401
  • Local law: means any charter, code, ordinance, resolution, regulation or other law of a local government. See Arizona Laws 9-1401
  • Local license: means any license, agreement, permit or similar authorization that meets all of the following:

    (a) Allows a person to construct or operate a video service network within the boundaries of a local government. See Arizona Laws 9-1401

  • Location: means a place of business at which activity regulated by this chapter occurs. See Arizona Laws 6-1201
  • Location: means the entire space in which a licensee provides deferred presentment services. See Arizona Laws 6-1251
  • Medical clinic: means a facility, whether mobile or stationary, which provides ambulatory medical care in a medically-underserved area through the employment of physicians, professional nurses, physician assistants or other health care technical and paraprofessional personnel. See Arizona Laws 36-2351
  • Medical emergency: means a condition that, on the basis of the physician's good faith clinical judgment, so complicates the medical condition of a pregnant woman as to necessitate the immediate abortion of her pregnancy to avert her death or for which a delay will create serious risk of substantial and irreversible impairment of a major bodily function. See Arizona Laws 36-2151
  • Medication abortion: means the use of any medication, drug or other substance that is intended to cause or induce an abortion. See Arizona Laws 36-2151
  • Money: means a medium of exchange that is authorized or adopted by a domestic or foreign government as a part of its currency and that is customarily used and accepted as a medium of exchange in the country of issuance. See Arizona Laws 6-1201
  • Money transmitter: means a person who is located or doing business in this state, including a check casher and a foreign money exchanger, and who does any of the following:

    (a) Sells or issues payment instruments. See Arizona Laws 6-1201

  • Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Narcotic drug: means any of the following whether produced directly or indirectly by extraction from substances of vegetable origin or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis:

    (a) Opium and opiate and any salt, compound, derivation or preparation of opium or opiate. See Arizona Laws 36-2501

  • National certification organization: means a national organization that tests and certifies the ability of an emergency medical care technician and whose tests are based on national education standards. See Arizona Laws 36-2201
  • National education standards: means the emergency medical services education standards of the United States department of transportation or other similar emergency medical services education standards developed by that department or its successor agency. See Arizona Laws 36-2201
  • negligently: import a want of such attention to the nature or probable consequence of the act or omission as a prudent man ordinarily bestows in acting in his own concerns. See Arizona Laws 1-215
  • Nutritional supplement: means any vitamin essential to, important in, or claimed to have value in human nutrition, which shall include laetrile or amygdalin, also known as vitamin B-17. See Arizona Laws 36-2451
  • Oath: includes an affirmation or declaration. See Arizona Laws 1-215
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Opiate: means any substance having an addiction-forming or addiction-sustaining liability similar to morphine or being capable of conversion into a drug having addiction-forming or addiction-sustaining liability. See Arizona Laws 36-2501
  • Opium poppy: means the plant of the genus papaver, except its seeds. See Arizona Laws 36-2501
  • Outstanding payment instruments: means unpaid payment instruments whose sale has been reported to a licensee. See Arizona Laws 6-1201
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Paramedic: means a person who has been trained in a paramedic program certified by the director or in an equivalent training program and who is certified by the director to render services pursuant to section 36-2205. See Arizona Laws 36-2201
  • Partner: means a person who either:

    (a) Is authorized by law or a partnership agreement to participate in the management of the business of the partnership. See Arizona Laws 6-1251

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Payment instrument: means a check, draft, money order, traveler's check or other instrument or order for the transmission or payment of money sold to one or more persons whether or not that instrument or order is negotiable. See Arizona Laws 6-1201
  • Peace officers: means sheriffs of counties, constables, marshals, policemen of cities and towns, commissioned personnel of the department of public safety, personnel who are employed by the state department of corrections and the department of juvenile corrections and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a multicounty water conservation district and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by community college district governing boards and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the Arizona board of regents and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the governing body of a public airport pursuant to section 28-8426 and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a private postsecondary institution pursuant to section 15-1897 and who have received a certificate from the Arizona peace officer standards and training board and special agents from the office of the attorney general, or of a county attorney, and who have received a certificate from the Arizona peace officer standards and training board.   • Permissible investment: means any of the following:

    (a) Money on hand or on deposit in the name of the licensee. See Arizona Laws 6-1201

  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Physician: means any person licensed pursuant to title 32, chapter 13 or 17. See Arizona Laws 36-2201
  • Physician: means a physician licensed pursuant to title 32, chapter 13 or 17. See Arizona Laws 36-2351
  • Physician: means a person who is licensed pursuant to title 32, chapter 13 or 17. See Arizona Laws 36-2151
  • Physician: means a physician who is licensed pursuant to title 32, chapter 13 or 17, and who provides medical oversight services pursuant to section 36-2262. See Arizona Laws 36-2261
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Poppy straw: means all parts, except the seeds, of the opium poppy after mowing. See Arizona Laws 36-2501
  • Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
  • pregnancy: means a female reproductive condition of having a developing unborn child in the body and that begins with conception. See Arizona Laws 36-2151
  • Probable gestational age: means the gestational age of the unborn child at the time the abortion is planned to be performed and as determined with reasonable probability by the attending physician. See Arizona Laws 36-2151
  • Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
  • Producer: means a person engaged in this state in the business of commercially producing or causing citrus to be commercially produced. See Arizona Laws 3-468
  • Property: includes both real and personal property. See Arizona Laws 1-215
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Purchase or sell: includes an exchange of cash, an in-kind payment or any other valuable financial or nonfinancial consideration. See Arizona Laws 36-2311
  • Quality assurance activities: means activities or proceedings of a health care entity:

    (a) That are established for the purposes of reducing morbidity and mortality and for improving the quality of health care or encouraging proper utilization of health care services and facilities through the review of the qualifications, professional practices, training, experience, patient care, conduct, processes or data of licensed health care providers. See Arizona Laws 36-2401

  • Quality assurance information: means information in oral, written or digital form that is submitted to, prepared for or by or considered by a health care entity for or in the course of quality assurance activities, including the record of the health care entity's actions and proceedings. See Arizona Laws 36-2401
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Registrant: means a person registered under the provisions of the federal controlled substances act (P. See Arizona Laws 36-2501
  • Responsible individual: means a person who is employed by a licensee and who has principal active management authority over the business of the licensee in this state that is regulated under this chapter. See Arizona Laws 6-1201
  • Rural: means either of the following:

    (a) A county with a population of less than four hundred thousand persons according to the most recent United States decennial census. See Arizona Laws 36-2171

  • Service area: means that part of the boundaries of a local government within which a video service provider is authorized to provide video service pursuant to a uniform video service license or a local license. See Arizona Laws 9-1401
  • Service of process: The service of writs or summonses to the appropriate party.
  • Sober living home: means any premises, place or building that provides alcohol-free or drug-free housing and that:

    (a) Promotes independent living and life skills development. See Arizona Laws 36-2061

  • State: when applied to a part of the United States, means any state, district, commonwealth, territory or insular possession of the United States and any area subject to the legal authority of the United States of America. See Arizona Laws 36-2501
  • State health care provider: means a department, agency, board or commission of the state and its officers, agents and employees that is a health care provider to clients, wards, patients or other persons in the control or custody of a department, agency, board or commission of the state and a health care provider rendering health care services on behalf of the state that is covered by insurance or self-insurance pursuant to section 41-621, 41-622 or 41-623. See Arizona Laws 36-2401
  • Statute: A law passed by a legislature.
  • Stretcher van: means a vehicle that contains a stretcher and that is operated to accommodate an incapacitated person or person with a disability who does not require medical monitoring, aid, care or treatment during transport. See Arizona Laws 36-2201
  • Suboperation station: means a physical facility or location at which an ambulance service conducts operations for the dispatch of ambulances and personnel and that may be staffed twenty-four hours a day or less as determined by system use. See Arizona Laws 36-2201
  • Subpoena: A command to a witness to appear and give testimony.
  • Subscriber: means any person in this state that purchases video service. See Arizona Laws 9-1401
  • subscription: includes a mark, if a person cannot write, with the person's name written near it and witnessed by a person who writes the person's own name as witness. See Arizona Laws 1-215
  • Superintendent: means the superintendent of financial institutions. See Arizona Laws 6-101
  • Surgical abortion: means the use of a surgical instrument or a machine to terminate the clinically diagnosable pregnancy of a woman with knowledge that the termination by those means will cause, with reasonable likelihood, the death of the unborn child. See Arizona Laws 36-2151
  • Telecommunications provider: means a person that is required to obtain from the corporation commission a certificate of public convenience and necessity to provide telecommunications service. See Arizona Laws 9-1401
  • Testify: includes every manner of oral statement under oath or affirmation. See Arizona Laws 1-215
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Title: includes this title, title 32, chapters 9 and 36 and title 44, chapter 2. See Arizona Laws 6-101
  • Trained user: means a person who is the expected user of an automated external defibrillator and who has completed training in its use. See Arizona Laws 36-2261
  • Training: means a state approved course in cardiopulmonary resuscitation and the use of an automated external defibrillator for the lay rescuer and first responder, including the course adopted by the American heart association and in effect as of December 31, 1998. See Arizona Laws 36-2261
  • Transmitting money: means the transmission of money by any means including transmissions within this country or to or from locations abroad by payment instrument, wire, facsimile, internet or any other electronic transfer, courier or otherwise. See Arizona Laws 6-1201
  • Trauma center: means any acute care hospital that provides in-house twenty-four hour daily dedicated trauma surgical services that is designated pursuant to section 36-2225. See Arizona Laws 36-2201
  • Trauma registry: means data collected by the department on trauma patients and on the incidence, causes, severity, outcomes and operation of a trauma system and its components. See Arizona Laws 36-2201
  • Trauma system: means an integrated and organized arrangement of health care resources having the specific capability to perform triage, transport and provide care. See Arizona Laws 36-2201
  • Treatment: means the broad range of emergency, outpatient, intermediate and inpatient services and care, including diagnostic evaluation, medical, psychiatric, psychological and social service care, vocational rehabilitation and career counseling, which may be extended to alcoholics and intoxicated persons. See Arizona Laws 36-2021
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Ultrasound: means the use of ultrasonic waves for diagnostic or therapeutic purposes to monitor a developing unborn child. See Arizona Laws 36-2151
  • Unborn child: means the offspring of human beings from conception until birth. See Arizona Laws 36-2151
  • Uniform video service license: means a license that is issued by a local government in the form of a uniform video service license agreement as adopted pursuant to section 9-1411. See Arizona Laws 9-1401
  • United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
  • Validated testing procedure: means a testing procedure that is inclusive of practical skills, or an attestation of practical skills proficiency on a form developed by the department by the educational training program, identified pursuant to section 36-2204, paragraph 2, that is certified as valid by an organization capable of determining testing procedure and testing content validity and that is recommended by the medical direction commission and the emergency medical services council before the director's approval.   • Wheelchair van: means a vehicle that contains or that is designed and constructed or modified to contain a wheelchair and that is operated to accommodate an incapacitated person or person with a disability who does not require medical monitoring, aid, care or treatment during transport. See Arizona Laws 36-2201
  • Wilfully: means , with respect to conduct or to a circumstance described by a statute defining an offense, that a person is aware or believes that the person's conduct is of that nature or that the circumstance exists. See Arizona Laws 1-215
