Terms Used In Delaware Code > Title 31 > Chapter 51 - Services for Justice-Involved Youth

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Bequest: Property gifted by will.
  • Board: means the Tourism Advisory Board created by § 8708A of this title. See Delaware Code Title 29 Sec. 8702A
  • Chambers: A judge's office.
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child: means a person who has not reached the age of 18 years. See Delaware Code Title 1 Sec. 302
  • Commitment: refers to the vesting of legal custody of juveniles in the custody of the Department of Services for Children, Youth and Their Families under the provisions of §§ 5106-5108 of this title. See Delaware Code Title 31 Sec. 5101
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the Council on Development Finance created by § 8707A of this title. See Delaware Code Title 29 Sec. 8702A
  • Court: means any court of competent jurisdiction. See Delaware Code Title 31 Sec. 5101
  • Department: means the Department of Services for Children, Youth and Their Families. See Delaware Code Title 31 Sec. 5101
  • Detention: refers to the holding of a juvenile by the Department in the separate Detention Department provided for in § 5110 of this title. See Delaware Code Title 31 Sec. 5101
  • Devise: To gift property by will.
  • Director: means the Director of the Division of Small Business. See Delaware Code Title 29 Sec. 8702A
  • Division: means the Division of Small Business. See Delaware Code Title 29 Sec. 8702A
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juvenile: means a minor. See Delaware Code Title 31 Sec. 5101
  • Ordinary medical care: shall mean medical examination, medical treatment including surgical procedures and mental health treatment other than inpatient psychiatric hospitalization. See Delaware Code Title 31 Sec. 5101
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Plan: means the Comprehensive State Plan for Economic Development created by § 8705A of this title. See Delaware Code Title 29 Sec. 8702A
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Quorum: The number of legislators that must be present to do business.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Secretary: means the Secretary of State. See Delaware Code Title 29 Sec. 8702A
  • State: means the State of Delaware. See Delaware Code Title 29 Sec. 8702A
