(1) The following acts shall constitute grounds for which disciplinary action against a chiropractic physician specified in Florida Statutes § 460.413, may be taken:
    (a) Allowing an employee to hold himself or herself out as a certified chiropractic physician’s assistant, in any manner or form, when such employee has not been so certified by the Department or when the chiropractic physician or group of physicians have not been certified by the Board as supervising physicians, or
    (b) Failing to supervise a certified chiropractic physician’s assistant as provided in subsection 64B2-18.001(7), F.A.C.
    (2) The certification of an assistant may be revoked by the Department when, after due notice and a hearing in accordance with the provisions of this rule, it finds the assistant guilty of misconduct. Misconduct includes, but is not limited to, a finding:
    (a) That the assistant has held himself or herself out or permitted another to represent himself or herself as a licensed physician;
    (b) That the assistant has in fact performed otherwise than at the direction and under the supervision of a physician licensed by the Board;
    (c) That the assistant has performed a task or tasks beyond his or her competence;
    (d) That the assistant is an habitual user of intoxicants or drugs or any chemical to such an extent that he or she is unable to perform competently and with safety to the patients in his or her capacity as a certified chiropractic physician’s assistant;
    (e) That the assistant has been adjudicated a mental incompetent or whose mental conditions renders him or her unable to safely perform as a certified chiropractic physician’s assistant;
    (f) That the assistant has failed to comply with any of the provisions of Fl. Admin. Code R. 64B2-18.007, or
    (g) Sexual misconduct in the practice.
    (3) All administrative hearings pursuant to this rule shall be conducted in accordance with Florida Statutes Chapter 460, and Florida Statutes Chapter 120
