(1) “”Mediation”” means a process whereby a mediator appointed by the Department acts to encourage and facilitate resolution of a legally sufficient complaint. It is an informal and nonadversarial process with the objective of assisting the parties to reach a mutually acceptable agreement.

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
    (2) For purposes of Florida Statutes § 456.078, the Board designates as being appropriate for mediation:
    (a) First time violations of Florida Statutes § 456.032, by the issuance to the Department of a check not supported by sufficient funds.
    (b) First time disputes or issues with regard to whether the registration certificate holder provided the necessary information to carry out the purposes of Florida Statutes Chapter 466, including proof of having the necessary equipment and supplies in the appropriate condition as required by Florida Statutes § 466.036
    (c) First time disputes or issues with regard to whether the registration certificate holder is in violation of Fl. Admin. Code R. 64B27-1.001
