(1) In the absence of evidence to the contrary, an unclaimed demand, savings, or checking account from a financial institution as defined in Florida Statutes § 655.005, reported to the Department as an “”and”” account or as an “”or”” account, or otherwise reported in the name of two or more persons shall be treated as a survivorship account notwithstanding Fl. Admin. Code R. 69G-20.0028

  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
    (2) This rule relates to proving entitlement pursuant to Florida Statutes § 717.126, and shall not be interpreted as affecting any private cause of action that one account holder may have against a joint account holder.
