§ 391. Consolidated health district; board of health; organization. 1. In every consolidated health district there shall be a board of health which shall consist of the supervisor of each town, the president of the board of trustees of each village, and the mayor and the supervisors of each city included in each district, provided that if the number of members so provided for is an even number less than seven, such members shall within thirty days after such district shall have been established by the commissioner choose an additional member of such board of health to be known as the elective member, and if the number of members so provided for is more than seven such members shall meet and elect a board of health of three members for such consolidated health district.

2. A member of the board, sitting ex-officio and not as one of a new board of three elected as hereinbefore provided, who is the lawful incumbent of more than one of the offices entitling him to membership shall have as many votes in the board as there are municipalities of the district, in which he holds such offices, and in such a case the total number of votes on the board shall be regarded as the number of members, in applying the provisions hereof relative to the choosing of an additional member or reducing the membership to a board of three.
