Any such local law, ordinance or resolution shall provide an equitable method of computing the amount of such payments. The supplemental retirement allowances paid to local retired employees shall not exceed the supplemental retirement allowances paid to state retired employees pursuant to this article. The supplemental retirement allowances paid to local retired teachers shall not exceed the supplemental retirement allowances paid to state retired teachers pursuant to this article. Any such local law, ordinance or resolution may contain provisions necessary and appropriate for the proper administration of such supplemental retirement allowance payments, including a provision requiring the filing of verified applications for such payments.

Terms Used In N.Y. Retirement and Social Security Law 193

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
