  • Subpoena: A command to a witness to appear and give testimony.
Except for the parties to the arbitration and their agents, officers, and employees, all witnesses appearing pursuant to subpoena are entitled to receive fees and mileage in the same amount and under the same circumstances as prescribed by law for witnesses in civil actions in the Superior Court of Guam. The fee and mileage of a witness subpoenaed upon the application of a party to the arbitration shall be paid by that party. The fee and mileage of a witness subpoenaed solely upon the determination of the arbitrator or the majority of a panel of arbitrators shall be paid in the manner provided for the payment of the arbitrators’ expenses.
(a) The costs of each arbitrator’s fees and expenses, together with any

administrative fee may be assessed against any party in the award or may be assessed among parties in such proportions as may be determined in the arbitration award. Each party shall bear its own attorney’s fees in the arbitration proceeding.
