Terms Used In 21 Guam Code Ann. § 66404

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(a) Whenever there is insufficient evidence that any material or any construction does not conform to the requirements of this Title, or in order to substantiate claims for alternate materials or methods of construction, the building official may require tests

as proof of compliance to be made at the expense of the owner or his agent by an approved agency or laboratory listed in this Title.

(b) Tests shall be in accordance with generally recognized standard test procedures for the proposed use. In the absence of such standard test procedures, the building official shall specify the test procedure.

(c) The building official may require tests to be repeated, if at any time he has reason to believe that an approved use no longer conforms to the requirements upon when the approval was based.
