Terms Used In 7 Guam Code Ann. § 39205

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
) Before a child-custody determination is made under this Act, notice and an opportunity to be heard in accordance with the standards of § 108 must be given to all persons entitled to notice under the laws of Guam as in child-custody proceedings between residents of Guam, any parent whose parental rights have not been previously terminated, and any person having physical custody of the child.

(b) This Act does not govern the enforceability of a child-custody determination made without notice or an opportunity to be heard.

(c) The obligation to join a party and the right to intervene as a party in a child-custody proceeding under this Act are governed by the laws of Guam as in child-custody proceedings between residents of Guam.
