A will or any part thereof is revoked:
(a) By a subsequent will which revokes the prior will or part expressly or by inconsistency; or

  • person: includes a corporation as well as a natural person;

  • Testator: A male person who leaves a will at death.
  • Will: includes a codicil and any testamentary instrument that merely appoints an executor, revokes or revises another will, nominates a guardian, or expressly excludes or limits the right of an individual or class to succeed to property of the decedent passing by intestate succession. See Idaho Code 15-2-1102
  • (b) By being burned, torn, canceled, obliterated or destroyed, with the intent and for the purpose of revoking it by the testator or by another person in his presence and by his direction.
    (c) The revocation of a will executed in duplicate may be accomplished by revoking one (1) of the duplicates.
