Terms Used In Indiana Code 24-5-12-20

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Contract: A legal written agreement that becomes binding when signed.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • person: means an individual, an incorporated or unincorporated organization or association, or any other legal entity. See Indiana Code 24-5-12-4
  • seller: means a person who, personally, through salespersons, or through the use of an automated dialing and answering device, makes a solicitation if in the solicitation any one (1) of the following occurs:

   Sec. 20. In addition to any other remedies or penalties under this chapter, a person who is damaged by a seller‘s failure to comply with this chapter or by a seller’s breach of contract may bring an action for recovery of the person’s actual damages, including court costs and attorney‘s fees.
