Sec. 6.1. (a) Each judge of a superior court has the same power to do any of the following as is conferred on circuit courts or the judges of circuit courts:
(2) Issue writs of habeas corpus and of mandate and prohibition.
(1) Grant restraining orders and injunctions.
Terms Used In Indiana Code 33-33-10-6.1
- Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
(3) Appoint receivers, master commissioners to convey real property, and grant commissions for the examination of witnesses.
(4) Appoint other officers necessary to facilitate and transact the business of the court.
(b) This section expires January 1, 2025.
