Terms Used In Indiana Code > Title 22 > Article 4 > Chapter 39 - Deduction of Child Support Obligations

  • Child support obligations: includes only obligations which are being enforced pursuant to a plan described in Section 454 of the Social Security Act which has been approved by the Secretary of Health and Human Services under Title IV-D of the Social Security Act. See Indiana Code 22-4-39-1
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State or local child support enforcement agency: means any agency of any state or a political subdivision of the state operating pursuant to a plan described in subdivision (1). See Indiana Code 22-4-39-1
  • Summons: Another word for subpoena used by the criminal justice system.
  • Unemployment compensation: means any compensation payable under this article (including amounts payable by the department pursuant to an agreement under any federal law providing for compensation, assistance, or allowances with respect to unemployment). See Indiana Code 22-4-39-1
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
