  • agency: whenever used in this chapter , means and includes any board, bureau, commission, department, agency, or instrumentality of the state of Indiana; provided, however, this chapter shall not be construed to apply where:

  • agency: refers to every officer, board, commission, department, division, bureau, committee, employee, and other instrumentality of the state, including: state hospitals, state penal institutions, and other state institution enterprises and activities wherever located, except, unless specifically included, the following:

  • agricultural labor camp: includes at least one (1) building or structure, tent, trailer, or vehicle, including the land, established, operated, or used as living quarters for at least five (5) adult seasonal or temporary workers engaged in agricultural activities, including related food processing.   • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • anatomic pathology service: means any of the following performed by a physician or under the supervision of a physician on a sample taken from a human body:

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • assembly: means a collection of individuals gathered together at any location at any one (1) time for any purpose. See Indiana Code 16-41-22-2
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • avgas: means aviation fuel used in piston engine powered aircraft within the general aviation community. See Indiana Code 16-44-2-0.5
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • bed and breakfast establishment: means an operator occupied residence that meets the following conditions:

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC

  • certificate: means a certificate, letter, or other document that verifies that the individual has passed an accreditation examination given by an accredited testing service recognized by the Conference for Food Protection or an equivalent nationally recognized certification program as determined by the state department.   • certificate of free sale: means a document that:

  • Contract: A legal written agreement that becomes binding when signed.

  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • council: refers to the interagency state council on black and minority health. See Indiana Code 16-46-6-1
  • council: refers to the rare disease advisory council established by section 2 of this chapter. See Indiana Code 16-46-17-1
  • customer: means the individual for whom a prescription is written or electronically transmitted or the individual's representative. See Indiana Code 16-42-22-3
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Decedent: A deceased person.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • division: refers to the division of consumer protection created by IC 4-6-9-1. See Indiana Code 16-52-1-2
  • Docket: A log containing brief entries of court proceedings.
  • Documentary material: means the original or a copy of a book, record, report, memorandum, paper, communication, tabulation, chart, or other document. See Indiana Code 4-6-3-1
  • Donor: The person who makes a gift.

  • drug order: means an order that meets the following conditions:

  • drug sample: means a legend drug or a controlled substance that is manufactured, packaged, labeled, or otherwise marketed to be distributed and dispensed without consideration. See Indiana Code 16-42-21-2
  • DUAB: means the distressed unit appeal board. See Indiana Code 20-19-7-1
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.   • end consumer: means a person who is the last person to purchase any food product and who does not resell the food product. See Indiana Code 16-42-5.3-1

  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Executor: A male person named in a will to carry out the decedent

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • flour: means the following foods as defined in the definitions and standards of identity adopted by the state department:

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.

  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Local agency: means an administration, agency, authority, board, bureau, commission, committee, council, department division, institution, office, officer, service, or other similar body of a political subdivision created or established pursuant to law. See Indiana Code 4-6-3-1
  • local board of health: means a board established under IC 16-20-2, IC 16-20-3, IC 16-20-4, or IC 16-22-8. See Indiana Code 16-46-10-0.5

  • maternal morbidity: refers to any health condition occurring to an individual in Indiana that is attributable to or aggravated by pregnancy and childbirth. See Indiana Code 16-50-1-1
  • maternal mortality: refers to death, occurring in Indiana, of an individual during pregnancy through up to one (1) year after pregnancy, irrespective of the duration and site of the pregnancy, from any cause related to or aggravated by the pregnancy or management of the pregnancy.   • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • minority: means an individual identified as any of the following:

  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • motor fuel: means gasoline or gasoline-oxygenate blends suitable for use as a fuel in a motor vehicle. See Indiana Code 16-44-3-2
  • motor fuel outlet: means a location where motor fuel is sold at retail to the public. See Indiana Code 16-44-3-3
  • MTBE: refers to the gasoline additive methyl tertiary butyl ether. See Indiana Code 16-44-2-2.4
  • nonpublic school: has the meaning set forth in IC 20-18-2-12. See Indiana Code 16-41-37.5-0.3
  • Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • office: means the office of technology established by Indiana Code 16-45-4-1
  • office setting: means a location of a qualified provider where health care services are provided and that:

  • operator: means an owner or the owner's agent of a bed and breakfast establishment who resides within the establishment or on contiguous property. See Indiana Code 16-41-31-4
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • patient service revenue: includes similar terms, including net patient service revenue and patient care service revenue. See Indiana Code 16-51-1-4
  • person: means an individual, employer, employer association, nonprofit organization, for-profit organization, unit (as defined in IC 36-1-2-23), school corporation, charter school, accredited nonpublic school, research institution, health insurance plan, health insurance ministry, or any combination of these.   • person: means an individual, employer, employer association, nonprofit organization, for-profit organization, institution of higher education, health insurance plan, health ministry, or any combination of these. See Indiana Code 16-46-16.7-2
  • Person: means a human being, an incorporated or unincorporated organization, or association, a trustee or legal representative, the state of Indiana, a political subdivision, a state or local agency, or a group of such persons acting in concert. See Indiana Code 4-6-3-1

  • regulated professional: means an individual who is regulated by an entity described in Indiana Code 4-6-14-4
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
