1. The department may adopt rules pursuant to chapter 17A setting forth qualification requirements for persons applying for a servicer‘s license, including an examination.

Terms Used In Iowa Code 215.23

  • Department: means the department of agriculture and land stewardship. See Iowa Code 215.1
  • Payment: means the actual payment or tender of payment by a grain dealer to a seller of the agreed purchase price, or in the case of disputes as to sales of grain, the undisputed portion of the purchase price without reduction for any separate claim of the grain dealer against the seller. See Iowa Code 203.8
  • Rule: includes "regulation". See Iowa Code 4.1
  • Servicer: means an individual employed by a service agency who installs, services or repairs a commercial weighing or measuring device for hire, commission or salary. See Iowa Code 215.1
  • United States: includes all the states. See Iowa Code 4.1
 2. In determining a servicer’s qualifications, the department may consider the specifications of the United States national institute of standards and technology, handbook 44, “Specifications, Tolerances, and Technical Requirements for Weighing and Measuring Devices”, or the current successor or equivalent specifications adopted by the United States national institute of standards and technology.
 3. The department may require the payment of a license fee for an amount established by rule for each license issued under this section.
 4. A license shall expire two years from its date of issuance.
