Terms Used In Iowa Code 633.255
- Debts: includes liabilities of the decedent which survive, whether arising in contract, tort, or otherwise. See Iowa Code 633.3
- Surviving spouse: means the surviving wife or husband, as the case may be. See Iowa Code 633.3
In case the homestead is sold, the surviving spouse may use any or all of the spouse’s share to procure a homestead which shall be exempt from liability for all debts from which the former homestead would have been exempt.
