Terms Used In Iowa Code > Chapter 10B - Agricultural Landholding Reporting

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agricultural land: means the same as defined in section 9H. See Iowa Code 10B.1
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Child: includes child by adoption. See Iowa Code 4.1
  • clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative association: means any entity organized on a cooperative basis, including an association of persons organized under chapter 497, 498, or 499; an entity composed of entities organized under those chapters; or a cooperative organized under chapter 501 or 501A. See Iowa Code 10B.1
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Corporation: means a domestic or foreign corporation, including an entity organized pursuant to chapter 490, or a nonprofit corporation. See Iowa Code 10B.1
  • Correctional staff: means a person who is not a peace officer but who is employed by the department of corrections or a judicial district department of correctional services to work at or in a correctional institution, community-based correctional facility, or an institution under the management of the Iowa department of corrections which is used for the purposes of confinement of persons who have committed public offenses. See Iowa Code 708.3A
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dependent: A person dependent for support upon another.
  • Employee of the department of human services: means a person who is an employee of an institution controlled by the director of human services that is listed in section 218. See Iowa Code 708.3A
  • Employee of the department of revenue: means a person who is employed as an auditor, agent, tax collector, or any contractor or representative acting in the same capacity. See Iowa Code 708.3A
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Farming: means the same as defined in section 9H. See Iowa Code 10B.1
  • Fiduciary: A trustee, executor, or administrator.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Foreign business: means the same as defined in section 9I. See Iowa Code 10B.1
  • Foreign government: means the same as defined in section 9I. See Iowa Code 10B.1
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Health care provider: means an emergency medical care provider as defined in chapter 147A or a person licensed or registered under chapter 148, 148C, 148D, or 152 who is providing or who is attempting to provide emergency medical services, as defined in section 147A. See Iowa Code 708.3A
  • Human reproductive cloning: means human asexual reproduction, using somatic cell nuclear transfer, for implantation or attempted implantation into a woman's uterus or substitute for a woman's uterus. See Iowa Code 707C.3
  • Human somatic cell: means a diploid cell having a complete set of chromosomes obtained or derived from a living or deceased human body at any stage of development. See Iowa Code 707C.3
  • incapacitated: means a person is disabled or deprived of ability, as follows:

  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jailer: means a person who is employed by a county or other political subdivision of the state to work at a county jail or other facility used for purposes of the confinement of persons who have committed public offenses, but who is not a peace officer. See Iowa Code 708.3A
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • lessee: means a nonresident alien, foreign business, or foreign government, or an agent, trustee, or fiduciary acting on behalf of the nonresident alien, foreign business, or foreign government, or any other trade or business which is under the lessee's common control as provided in 26 U. See Iowa Code 9I.3
  • Licensed health care professional: means a physician and surgeon, podiatric physician, osteopathic physician and surgeon, physician assistant, nurse, dentist, or pharmacist required to be licensed under chapter 147. See Iowa Code 707A.1
  • Limited liability company: means a foreign or domestic limited liability company, including a limited liability company as defined in section 489. See Iowa Code 10B.1
  • Limited partnership: means a foreign or domestic limited partnership, including a limited partnership as defined in section 488. See Iowa Code 10B.1
  • Magistrate: means a judicial officer appointed under chapter 602, article 6, part 4. See Iowa Code 4.1
  • National guard: means the same as defined in section 29A. See Iowa Code 708.3A
  • National guard duty: means the same as defined in section 29A. See Iowa Code 708.3A
  • Nonresident alien: means the same as defined in section 9I. See Iowa Code 10B.1
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oocyte: means a human ovum. See Iowa Code 707C.3
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Physically helpless: means that a person is unable to communicate an unwillingness to act because the person is unconscious, asleep, or is otherwise physically limited. See Iowa Code 709.1A
  • Physically incapacitated: means that a person has a bodily impairment or handicap that substantially limits the person's ability to resist or flee. See Iowa Code 709.1A
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • property: includes personal and real property. See Iowa Code 4.1
  • Reporting entity: means any of the following:
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Somatic cell nuclear transfer: means a technique in which the nucleus of a human somatic cell is injected or transplanted into a fertilized or unfertilized oocyte from which the nucleus has been removed. See Iowa Code 707C.3
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • State active duty: means the same as defined in section 29A. See Iowa Code 708.3A
  • Statute: A law passed by a legislature.
  • Suicide: means the act or instance of taking a person's own life voluntarily and intentionally. See Iowa Code 707A.1
  • Summons: Another word for subpoena used by the criminal justice system.
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • United States: includes all the states. See Iowa Code 4.1
  • year: means twelve consecutive months. See Iowa Code 4.1
