Terms Used In Iowa Code > Chapter 717A - Offenses Relating to Agricultural Production

  • Agricultural animal: means any of the following:
  • Agricultural production: means any activity related to maintaining an agricultural animal at an animal facility or a crop on crop operation property. See Iowa Code 717A.1
  • Agricultural production facility: means an animal facility as defined in subsection 5, paragraph "a" or a crop operation property. See Iowa Code 717A.1
  • Animal: means a warm-blooded or cold-blooded animal, including but not limited to an animal belonging to the bovine, canine, feline, equine, ovine, or porcine species; farm deer as defined in section 189A. See Iowa Code 717A.1
  • Animal facility: means any of the following:
  • Consent: means express or apparent assent by a person authorized to provide such assent. See Iowa Code 717A.1
  • Conviction: A judgement of guilt against a criminal defendant.
  • Crop: means any plant maintained for its parts or products having commercial value, including but not limited to stalks, trunks and branches, cuttings, grafts, scions, leaves, buds, fruit, vegetables, roots, bulbs, or seeds, if the plant is any of the following:
     (1) A plant produced from an agricultural seed or vegetable seed as defined in section 199. See Iowa Code 717A.1
  • Crop operation: means a commercial enterprise where a crop is maintained on the property of the commercial enterprise. See Iowa Code 717A.1
  • Crop operation property: means any of the following:
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Deprive: means to do any of the following:
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Fraud: Intentional deception resulting in injury to another.
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Livestock: includes but is not limited to an animal classified as an ostrich, rhea, or emu. See Iowa Code 4.1
  • Owner: means any of the following:
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • property: includes personal and real property. See Iowa Code 4.1
  • Research crop: means a crop, including the crop's seed, that is maintained for purposes of scientific research regarding the study or alteration of the genetic characteristics of a plant or associated seed, including its deoxyribonucleic acid, which is accomplished by breeding or by using biotechnological systems or techniques. See Iowa Code 717A.1
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
