Terms Used In Iowa Code > Chapter 717B - Mistreatment of Animals

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Animal: means a nonhuman vertebrate. See Iowa Code 717B.1
  • Animal care provider: means a person designated by a local authority to provide care to an animal which is rescued by the local authority pursuant to section 717B. See Iowa Code 717B.1
  • Child: includes child by adoption. See Iowa Code 4.1
  • clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
  • Commercial establishment: means a commercial establishment as defined in section 162. See Iowa Code 717B.1
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Convicted: means the entry of a judgment of conviction under chapter 901 or adjudicated delinquent for an act which is an indictable offense in this state or in another state under chapter 232. See Iowa Code 717B.1
  • Conviction: A judgement of guilt against a criminal defendant.
  • Department: means the department of agriculture and land stewardship. See Iowa Code 717B.1
  • Dispositional expenses: means expenses incurred by a local authority in rescuing an animal as provided in section 717B. See Iowa Code 717B.1
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Euthanasia: means the same as defined in section 162. See Iowa Code 717B.1
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Injury: means an animal's disfigurement; the impairment of an animal's health; or an impairment to the functioning of an animal's limb or organ, including physical damage or harm to an animal's muscle, tissue, organs, bones, hide, or skin. See Iowa Code 717B.1
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Law enforcement officer: means a regularly employed member of a police force of a city or county, including a sheriff, who is responsible for the prevention and detection of crime and the enforcement of the criminal laws of this state. See Iowa Code 717B.1
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Local authority: means a city as defined in section 362. See Iowa Code 717B.1
  • Maintenance: means to provide on-site or off-site care to neglected animals. See Iowa Code 717B.1
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • property: includes personal and real property. See Iowa Code 4.1
  • Responsible party: means a person who owns or maintains an animal. See Iowa Code 717B.1
  • Serious injury: means an injury that constitutes an animal's protracted or permanent disfigurement, the protracted or permanent impairment of an animal's health, the protracted or permanent impairment of the functioning of an animal's limb or organ, or the loss of an animal's limb or organ. See Iowa Code 717B.1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • Threatened animal: means an animal that is abused as provided in section 717B. See Iowa Code 717B.1
  • United States: includes all the states. See Iowa Code 4.1
  • Veterinarian: means a veterinarian licensed pursuant to chapter 169 who practices veterinary medicine in this state. See Iowa Code 717B.1
