Terms Used In Iowa Code > Chapter 717F - Dangerous Wild Animals

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agricultural animal: means an agricultural animal as defined in section 717A. See Iowa Code 717F.1
  • Assistive animal: means a simian or other animal specially trained or in the process of being trained to assist a person with a disability. See Iowa Code 717F.1
  • Circus: means a person who is all of the following:
     (1) The holder of a class "C" license issued by the United States department of agriculture as provided in Iowa Code 717F.1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Custody: means to possess, control, keep, or harbor a dangerous wild animal in this state by a public agency. See Iowa Code 717F.1
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dangerous wild animal: includes an animal which is the offspring of an animal provided in paragraph "a" and another animal provided in that paragraph or any other animal. See Iowa Code 717F.1
  • Department: means the department of agriculture and land stewardship. See Iowa Code 717F.1
  • Electronic identification device: means a device which when installed is designed to store information regarding an animal or the animal's owner in a digital format which may be accessed by a computer for purposes of reading or manipulating the information. See Iowa Code 717F.1
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Possess: means to own, keep, or control a dangerous wild animal, or supervise or provide for the care and feeding of a dangerous wild animal, including any activity relating to confining, handling, breeding, transporting, or exhibiting the dangerous wild animal. See Iowa Code 717F.1
  • property: includes personal and real property. See Iowa Code 4.1
  • Public agency: means the same as defined in section 28E. See Iowa Code 717F.1
  • Research facility: means any of the following:
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • United States: includes all the states. See Iowa Code 4.1
  • Wildlife sanctuary: means an organization exempt from taxation pursuant to section 501(c) of the Internal Revenue Code that operates a place of refuge where abused, neglected, unwanted, impounded, abandoned, orphaned, or displaced wildlife are provided care for their lifetime, if all of the following apply:
  • year: means twelve consecutive months. See Iowa Code 4.1
