Terms Used In Kansas Statutes 65-34,119a

  • Corrective action: means those activities described in subsection (a) of Kan. See Kansas Statutes 65-34,142
  • Fund: means the drycleaning facility release trust fund. See Kansas Statutes 65-34,142
  • Owner: means any person who owns or leases, or has owned or leased, a drycleaning facility and who is or has been responsible for the operation of drycleaning operations at such drycleaning facility. See Kansas Statutes 65-34,142
  • Release: means any spill, leak, emission, discharge, escape, leak or disposal of drycleaning solvent from a drycleaning facility into the soils or waters of the state. See Kansas Statutes 65-34,142

(a) An owner or operator shall be entitled to reimbursement from the underground fund for the costs of corrective action taken on or after April 1, 1990, in response to a release from an underground petroleum storage tank which was discovered on or after December 22, 1988, to the extent that such owner or operator would be entitled to reimbursement if the release had been discovered on or after April 1, 1990, including application of all applicable deductibles and conditions of reimbursement imposed by Kan. Stat. Ann. § 65-34,119 and amendments thereto.

(b) This section shall be part of and supplemental to the Kansas storage tank act.
