The Cabinet for Health and Family Services shall place a substance in Schedule II if it finds that:
(1) The substance has high potential for abuse;

Terms Used In Kentucky Statutes 218A.060

  • Cabinet: means the Cabinet for Health and Family Services. See Kentucky Statutes 218A.010
  • Treatment: when used in a criminal justice context, means targeted interventions
    that focus on criminal risk factors in order to reduce the likelihood of criminal behavior. See Kentucky Statutes 446.010

(2) The substance has currently accepted medical use in treatment in the United States, or currently accepted medical use with severe restrictions; and
(3) The abuse of the substance may lead to severe psychic or physical dependence.
