Terms Used In Louisiana Revised Statutes 11:1658

  • Board of Trustees: shall mean the Board provided for in La. See Louisiana Revised Statutes 11:1581
  • Employer: shall mean any parish in the state of Louisiana; the state of Louisiana, or the police jury or any other governing body of a parish or political corporation or subdivision of the state of Louisiana which employs and pays persons as district attorneys or assistant district attorneys.   • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.

            A. Notwithstanding the provisions of La. Rev. Stat. 11:103 and 104, in any fiscal year the board of trustees is authorized to take any of the following actions:

            (1) Maintain the net direct employer contribution rate in effect at the time that a decrease would otherwise occur pursuant to La. Rev. Stat. 11:103.

            (2) Require a net direct contribution rate of up to three percentage points more than the rate determined under La. Rev. Stat. 11:103.

            (3) Set the employer contribution rate at any point between the previous year’s employer contribution rate and a decreased rate that would otherwise occur pursuant to La. Rev. Stat. 11:103.

            B. Any excess funds resulting from application of Subsection A of this Section shall be combined with any contribution surplus or offset by any contribution shortfall, and the resulting balance, if greater than zero, shall be accumulated in the funding deposit account pursuant to La. Rev. Stat. 11:1659.

            C. Repealed by Acts 2017, No. 25, §1.
