Terms Used In Louisiana Revised Statutes 3:1481

  • Commissioner: means the commissioner of the office of alcohol and tobacco control. See Louisiana Revised Statutes 3:1481
  • Consumable hemp product: means any product derived from industrial hemp that contains any cannabinoid, including cannabidiol, and is intended for consumption or topical use. See Louisiana Revised Statutes 3:1481
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Louisiana Department of Health. See Louisiana Revised Statutes 3:1481
  • hemp: means the plant Cannabis sativa L. See Louisiana Revised Statutes 3:1481
  • Package: means a container or wrapping in which any consumer commodity is enclosed for the purpose of delivery or display of that commodity to retail purchasers and contains one or more servings. See Louisiana Revised Statutes 3:1481
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual or any legal or commercial entity, including a corporation, business trust, partnership, limited liability company, association, or joint venture. See Louisiana Revised Statutes 3:1
  • sale at retail: means the sale or any transaction in lieu of a sale of products to the public for use or consumption but does not include the sale or any transaction in lieu of a sale of products for resale. See Louisiana Revised Statutes 3:1481
  • THC: means a combination of tetrahydrocannabinol and tetrahydrocannabinolic acid. See Louisiana Revised Statutes 3:1481

            As used in this Part:

            (1) “Adult-use consumable hemp product” means any consumable hemp product that contains more than 0.5 milligrams of total THC per package.

            (2) “Commissioner” means the commissioner of the office of alcohol and tobacco control.

            (3) “Consumable hemp processor” means any individual, partnership, corporation, cooperative association, or other business entity that receives industrial hemp for the manufacturing or processing of a consumable hemp product.

            (4)(a) “Consumable hemp product” means any product derived from industrial hemp that contains any cannabinoid, including cannabidiol, and is intended for consumption or topical use.

            (b) “Consumable hemp product” shall include commercial feed, pet products, and hemp floral material.

            (5) “Department” means the Louisiana Department of Health.

            (6) “Industrial hemp” or “hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a total delta-9 THC concentration of not more than 0.3 percent on a dry weight basis.

            (7) “Package” means a container or wrapping in which any consumer commodity is enclosed for the purpose of delivery or display of that commodity to retail purchasers and contains one or more servings.

            (8) “Remote retailer” means a person or entity who offers any consumable hemp product for sale at retail, or for any transaction of products in lieu of a sale, through a digital application, catalog, or the internet, that can be purchased and delivered directly to a consumer in Louisiana.

            (9) “Retail sale” or “sale at retail” means the sale or any transaction in lieu of a sale of products to the public for use or consumption but does not include the sale or any transaction in lieu of a sale of products for resale.

            (10) “Retailer” means a person or entity who offers any consumable hemp product for sale at retail.

            (11) “Serving” means the total amount of individual units or amount of liquid of a product recommended by the manufacturer to be consumed at a single time.

            (12) “State plan” means a plan required for approval by the United States Secretary of Agriculture to monitor and regulate the production of hemp.

            (13) “THC” means a combination of tetrahydrocannabinol and tetrahydrocannabinolic acid.

            (14) “Wholesaler” means a wholesale seller, distributor, or packer of consumable hemp products.
