Terms Used In Louisiana Revised Statutes 40:2115.20

  • Department: means the Louisiana Department of Health. See Louisiana Revised Statutes 40:2102
  • Hospital: means any institution, place, building, or agency, public or private, whether for profit or not, with facilities for the diagnosis, treatment, or care of persons who are suffering from illness, injury, infirmity, or deformity or other physical condition for which obstetrical, medical, or surgical services would be available and appropriate and which operates or is affiliated with facilities for the overnight care, observation, or recovery of those persons.   • Statute: A law passed by a legislature.

A.  No license to operate a hospital may be issued or renewed by the department pursuant to this Subpart or any other state statute, and a license that has been issued may be revoked or suspended if any of the following occurs:

(1)  There is an acquisition of a hospital without first having received the approval of the attorney general.

(2)  There is an acquisition of a hospital and the attorney general disapproves the acquisition.

(3)  The hospital is not fulfilling its commitment under La. Rev. Stat. 40:2115.18(2) or is not following procedures or safeguards committed pursuant to La. Rev. Stat. 40:2115.18(3).

B.  Any decision to refuse to issue or renew a license under this Subpart, and any action to revoke or suspend a license under this Subpart, shall conform to the procedure for issuance, renewal, revocation and suspension of licensure in La. Rev. Stat. 40:2109 et seq., and the regulations promulgated thereunder.
