Abuse: includes acts and omissions. See Maine Revised Statutes Title 22 Sec. 3472
Academic detailing: means the provision of information regarding prescription drugs based on scientific and medical research, including information on therapeutic and cost-effective use of prescription drugs. See Maine Revised Statutes Title 22 Sec. 2685
Accumulated contributions: means the sum of all the amounts credited to a member's individual account, together with regular interest thereon. See Maine Revised Statutes Title 4 Sec. 1201
Actuarial equivalent: means an amount of equal value when computed at the discount rate contained in actuarial assumptions adopted by the board of trustees. See Maine Revised Statutes Title 4 Sec. 1201
Adult: means any person who has attained 18 years of age or who is a legally emancipated minor. See Maine Revised Statutes Title 22 Sec. 3472
Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
Amortization: Paying off a loan by regular installments.
an event the result of which is determined by chance: includes but is not limited to a shuffle of a deck of cards, a roll of a die or dice or a random drawing or generation of an object that may include, but is not limited to, a card, a die, a number or simulations of any of these. See Maine Revised Statutes Title 17 Sec. 1831
Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
Any election: means primary and general elections and referenda, whether regular or special. See Maine Revised Statutes Title 21-A Sec. 1
Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
Average final compensation: means :

Average wholesale price: means the wholesale price charged on a specific commodity that is assigned by the drug manufacturer and is listed in a nationally recognized drug pricing file. See Maine Revised Statutes Title 22 Sec. 2681

Beano: means a specific kind of group game of chance, regardless of whether such a game is characterized by another name. See Maine Revised Statutes Title 17 Sec. 311

Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. ^{Source: OCC}

Beneficiary: means any person who receives or is designated to receive a benefit provided by this chapter. See Maine Revised Statutes Title 4 Sec. 1201

Board: means the Manufactured Housing Board or its employees. See Maine Revised Statutes Title 10 Sec. 9061

Board: means the Manufactured Housing Board. See Maine Revised Statutes Title 10 Sec. 9002

Board of trustees: means the board provided for in section 1231. See Maine Revised Statutes Title 4 Sec. 1201

Bottler: means a person that extracts water in this State to be sold as bottled water. See Maine Revised Statutes Title 22 Sec. 2660-AA

Business day: means any day of the calendar year other than a Saturday, Sunday or legal holiday. See Maine Revised Statutes Title 21-A Sec. 1

Candidate: means any person who has filed a petition under either sections 335 and 336 or sections 354 and 355 and has qualified as a candidate by either procedure, or any person who has received contributions or made expenditures or has given consent for any other person to receive contributions or make expenditures with the intent of qualifying as a candidate. See Maine Revised Statutes Title 21-A Sec. 1

Card game: means a game of chance conducted using one or more decks of cards, such as poker, blackjack or cribbage. See Maine Revised Statutes Title 17 Sec. 1831

Caretaker: means any individual or institution who has or assumes the responsibility for the care of an adult. See Maine Revised Statutes Title 22 Sec. 3472

Caucus: means a meeting of a political party or committee. See Maine Revised Statutes Title 21-A Sec. 1

Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.

Central voter registration system: means a single electronic information system and database for voter registration information maintained by the Secretary of State and used by all municipal jurisdictions in the State. See Maine Revised Statutes Title 21-A Sec. 1

Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.

Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72

Closed period: means that time period when the registrar may accept only those voter registration applications presented in person. See Maine Revised Statutes Title 21-A Sec. 1

Code: means the United States Internal Revenue Code of 1986, as amended. See Maine Revised Statutes Title 4 Sec. 1201

Commercial beano hall permit: means written authority from the Gambling Control Unit issued to a permittee who rents or leases premises for profit to a licensee to hold, conduct or operate "beano. See Maine Revised Statutes Title 17 Sec. 311

Commission: means the Maine Public Drinking Water Commission. See Maine Revised Statutes Title 22 Sec. 2660-B

Commissioner: means the Commissioner of Health and Human Services or a designated representative in the geographical area in which the person resides or is present. See Maine Revised Statutes Title 22 Sec. 3472

Commissioner: means the Commissioner of Professional and Financial Regulation. See Maine Revised Statutes Title 10 Sec. 9061

Community water system: means a public water system that serves at least 15 service connections used by year-round residents or regularly serves at least 25 year-round residents. See Maine Revised Statutes Title 22 Sec. 2660-B

Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.

Contaminant: means any physical, chemical, biological or radiological substance or matter in water. See Maine Revised Statutes Title 22 Sec. 2601

Continuance: Putting off of a hearing ot trial until a later time.

Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.

County office: means the office of judge of probate, register of probate, county treasurer, register of deeds, sheriff, district attorney or county commissioner. See Maine Revised Statutes Title 21-A Sec. 1

County or municipal law enforcement officer: means a person who by virtue of employment by a county or municipal government in the State is vested by law with the power to make arrests for crimes or serve criminal process, whether that power extends to all crimes or is limited to specific crimes. See Maine Revised Statutes Title 5 Sec. 286-M

Covered drugs: means drugs that are on the MaineCare preferred drug list established and revised from time to time by the department pursuant to its authority to operate the MaineCare program. See Maine Revised Statutes Title 22 Sec. 2681

Creditable service: means membership service and prior service as a judge which is credited towards retirement in accordance with subchapter IV. See Maine Revised Statutes Title 4 Sec. 1201

Criminal justice agency: includes the Department of the Attorney General, district attorneys' offices and the equivalent departments or offices in any federal or state jurisdiction. See Maine Revised Statutes Title 16 Sec. 803

Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.

Dealer: means any person engaged in the sale, leasing, or distribution of new manufactured homes primarily to persons who in good faith purchase or lease a manufactured home for purposes other than resale. See Maine Revised Statutes Title 10 Sec. 9061

Dealer: means a person engaged in the sale, offering for sale, brokering or distribution of manufactured housing to a licensed dealer, developer dealer or consumer. See Maine Revised Statutes Title 10 Sec. 9002

Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

Department: means the Department of Professional and Financial Regulation or its employees. See Maine Revised Statutes Title 10 Sec. 9061

Dependent: A person dependent for support upon another.

Dependent: means a spouse, an unmarried child under 19 years of age, a child who is a student under 23 years of age and financially dependent upon the enrollee, a child of any age who is disabled and dependent upon the enrollee or a domestic partner. See Maine Revised Statutes Title 5 Sec. 286-M

Dependent adult: includes , but is not limited to, any of the following:

Developer dealer: means a person who purchases state-certified manufactured housing from a licensed manufacturer or dealer for placement on property owned by the developer dealer and who offers the manufactured housing for sale to the initial purchaser of the manufactured housing. See Maine Revised Statutes Title 10 Sec. 9002

Director: means the Executive Director of the Gambling Control Board and the Gambling Control Unit. See Maine Revised Statutes Title 17 Sec. 311

Director: means the Executive Director of the Gambling Control Unit. See Maine Revised Statutes Title 17 Sec. 1831

Dirigo Health insurance: means the program of health coverage provided under Title 24-A, section 6910. See Maine Revised Statutes Title 22 Sec. 2685

Dissemination: means the transmission of information by any means, including but not limited to orally, in writing or electronically, by or to anyone outside the criminal justice agency that maintains the information. See Maine Revised Statutes Title 16 Sec. 803

Distributor: means a person, firm, corporation, association or organization, other than an Internet raffle operator, that sells, markets or otherwise distributes sealed tickets, gambling apparatus or any other implements of gambling that may be used in the conduct of a game of chance. See Maine Revised Statutes Title 17 Sec. 1831

Distributor: means any person engaged in the sale and distribution of manufactured homes for resale. See Maine Revised Statutes Title 10 Sec. 9061

Division: means the Division of Health Engineering within the Bureau of Health, Department of Human Services. See Maine Revised Statutes Title 22 Sec. 2660-B

Division: means the Department of Administrative and Financial Services, Office of Employee Health and Wellness. See Maine Revised Statutes Title 5 Sec. 286-M

Docket: A log containing brief entries of court proceedings.

Domestic partner: means one of 2 unmarried adults who are domiciled together under long-term arrangements that evidence a commitment to remain responsible indefinitely for each other's welfare. See Maine Revised Statutes Title 1 Sec. 72

Earnable compensation: means the annual salary as a judge. See Maine Revised Statutes Title 4 Sec. 1201

Educational facility: includes but is not limited to career or technical schools, high schools and postsecondary programs. See Maine Revised Statutes Title 10 Sec. 9002

Elderly low-cost drug program: means the elderly low-cost drug program provided under section 254-D. See Maine Revised Statutes Title 22 Sec. 2685

Election year: means the calendar year within which a particular election is held. See Maine Revised Statutes Title 21-A Sec. 1

Electronic video machine: means a machine, however operated, that has a video screen featuring an electronically simulated game and delivers or entitles the person playing or operating it to receive the privilege of playing the electronic video machine without charge, but does not deliver or entitle the person playing or operating the electronic video machine to receive cash, premiums, merchandise, tickets or something of value other than the privilege of playing the electronic video machine without charge. See Maine Revised Statutes Title 17 Sec. 1831

Emergency: refers to a situation in which:

emergency medical services line personnel: means persons who are career employees employed full-time by a public sector agency or employer and whose primary responsibility is to provide emergency medical services. See Maine Revised Statutes Title 5 Sec. 286-M

Emergency services: refers to those services necessary to avoid serious harm. See Maine Revised Statutes Title 22 Sec. 3472

Enroll: means to enlist as a member of a political party. See Maine Revised Statutes Title 21-A Sec. 1

Enrollee: means a county or municipal law enforcement officer or municipal firefighter who has enrolled in the program. See Maine Revised Statutes Title 5 Sec. 286-M

Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

Equipment: means the receptacle and numbered objects to be drawn from it; the master board upon which such objects are placed as drawn; the tally cards or sheets bearing such numbers to be covered and the objects used to cover them; the boards or signs, however operated, used to display the numbers as they are drawn; public address systems; and any other articles essential to the operation, conduct and playing of "Beano. See Maine Revised Statutes Title 17 Sec. 311

Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. ^{Source: U.S. Courts}

Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

Ex officio: Literally, by virtue of one's office.

Executor: A male person named in a will to carry out the decedent

Exploitation: means the illegal or improper use of an incapacitated or dependent adult or that adult's resources for another's profit or advantage. See Maine Revised Statutes Title 22 Sec. 3472

fair: means a nonprofit agricultural fair society eligible for a stipend under Title 7, chapter 4. See Maine Revised Statutes Title 17 Sec. 1831

Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.

Federal manufactured home construction and safety standard: means the standard for the construction, design and performance of a manufactured home that meets the needs of the public including the need for quality, durability and safety and that has been duly adopted by the Federal Government pursuant to the National Manufactured Housing Construction and Safety Standards Act of 1974, as amended by the Manufactured Housing Improvement Act of 2000, 42 United States Code § 5401, et seq. See Maine Revised Statutes Title 10 Sec. 9002

Fiduciary: A trustee, executor, or administrator.

Financial exploitation: means the use of deception, intimidation, undue influence, force or other unlawful means to obtain control over the property of a dependent adult for another's profit or advantage. See Maine Revised Statutes Title 22 Sec. 3472

Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.

Fraud: Intentional deception resulting in injury to another.

Fund: means the Public Drinking Water Fund. See Maine Revised Statutes Title 22 Sec. 2660-B

Fund: means the Firefighters and Law Enforcement Officers Health Insurance Program Fund established in subsection 7. See Maine Revised Statutes Title 5 Sec. 286-M

Game of chance: means a game, contest, scheme or device in which:

Game of skill: means any game, contest, scheme or device in which a person stakes or risks something of value for the opportunity to win something of value and that is not a game of chance. See Maine Revised Statutes Title 17 Sec. 1831

General election: means the regular election of state and county officials occurring biennially in November. See Maine Revised Statutes Title 21-A Sec. 1

Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,

Gross revenue: means the total amount wagered in a game of chance less the prizes awarded. See Maine Revised Statutes Title 17 Sec. 1831

group health insurance plan: means any employer-sponsored group health insurance plan, whether self-insured or fully insured, that provides coverage to eligible employees, retirees and their dependents. See Maine Revised Statutes Title 5 Sec. 286-M

Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.

Health care provider: means an appropriately licensed, certified or registered provider of mental or physical health care, in either the public or private sector. See Maine Revised Statutes Title 4 Sec. 1201

Health plan: means a health plan providing prescription drug coverage as authorized under the federal Medicare Prescription Drug, Improvement and Modernization Act of 2003, Public Law 108-173. See Maine Revised Statutes Title 22 Sec. 2685

High-hand competition: means a game of chance conducted during a tournament game in which the winner is the person who plays the highest hand of cards, according to the rules of the tournament, during the tournament game. See Maine Revised Statutes Title 17 Sec. 1831

Immediate family: means a person's spouse, parent, grandparent, child, grandchild, sister, half-sister, brother, half-brother, stepparent, stepgrandparent, stepchild, stepgrandchild, stepsister, stepbrother, mother-in-law, father-in-law, brother-in-law, sister-in-law, son-in-law, daughter-in-law, guardian, former guardian, domestic partner, the half-brother or half-sister of a person's spouse, or the spouse of a person's half-brother or half-sister. See Maine Revised Statutes Title 21-A Sec. 1

in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72

Incapacitated adult: means an adult who is unable to receive and evaluate information or make or communicate informed decisions to such an extent that the adult lacks the ability to meet essential requirements for physical health, safety or self-care, even with reasonably available appropriate technological assistance. See Maine Revised Statutes Title 22 Sec. 3472

Incoming voting list: means the printed list of all of the voters in a municipality that is used by election officials at a voting place to record which voters have been issued a ballot at an election. See Maine Revised Statutes Title 21-A Sec. 1

Inhabitant: means a person having an established residence in a place. See Maine Revised Statutes Title 1 Sec. 72

Inspection agency: means an approved person or organization, public or private, determined by the board to be qualified by reason of facilities, personnel and demonstrated ability and independence of judgment to provide for inspection and approval of the design, construction or installation of manufactured housing in compliance with the standards and the rules adopted in accordance with this Act. See Maine Revised Statutes Title 10 Sec. 9002

Installation: means :

Installer: means a person engaged in the installation or servicing of state-certified manufactured housing. See Maine Revised Statutes Title 10 Sec. 9002

Intelligence and investigative record information: includes information of record concerning investigative techniques and procedures and security plans and procedures prepared or collected by a criminal justice agency or other agency. See Maine Revised Statutes Title 16 Sec. 803

Internet raffle: means a raffle in which a person purchases a raffle chance or ticket through, and a winner or winning chances are determined by, a digital platform that involves, at least in part, the use of the Internet. See Maine Revised Statutes Title 17 Sec. 1831

Internet raffle operator: means a person, firm, corporation, association or organization licensed under section 1837?B, subsection 2 to conduct an Internet raffle using an Internet raffle system. See Maine Revised Statutes Title 17 Sec. 1831

Internet raffle system: means a mobile application or other digital platform and the accompanying computer software approved by the Gambling Control Unit under section 1837?B, subsection 4 for use in conducting an Internet raffle. See Maine Revised Statutes Title 17 Sec. 1831

Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.

Judge: means a Justice of the Supreme Judicial Court or the Superior Court, any Judge of the District Court, any Administrative Court Judge or any Associate Administrative Court Judge who is actively serving as of December 1, 1984, or who is appointed subsequent to December 1, 1984, but does not include Active Retired Judges. See Maine Revised Statutes Title 4 Sec. 1201

Labeler: means an entity or person that receives prescription drugs from a manufacturer or wholesaler and repackages those drugs for later retail sale and that has a labeler code from the federal Food and Drug Administration under 21 Code of Federal Regulations, 207. See Maine Revised Statutes Title 22 Sec. 2681

lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72

Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). ^{Source: OCC}

Legislative committee: means a joint standing committee of the Legislature, a joint select committee of the Legislature, a task force, commission or council or any other committee established by the Legislature and composed wholly or partly of Legislators for the purpose of conducting legislative business. See Maine Revised Statutes Title 5 Sec. 21

Legislative inquiry: means any request made by a legislative committee or individual Legislator to a state employee for public information or the state employee's personal opinion. See Maine Revised Statutes Title 5 Sec. 21

Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.

License: means written authority from the Gambling Control Unit to hold, conduct or operate "Beano". See Maine Revised Statutes Title 17 Sec. 311

Licensee: means any organization, including a federally recognized Indian tribe in the State, that has been granted a license by the Gambling Control Unit to hold, conduct or operate "Beano" or "Bingo. See Maine Revised Statutes Title 17 Sec. 311

Licensee: means a firm, corporation, association or organization licensed by the Gambling Control Unit to operate a game of chance. See Maine Revised Statutes Title 17 Sec. 1831

Lien: A claim against real or personal property in satisfaction of a debt.

Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.

Location permit: means that card issued by the Gambling Control Unit, describing the premises or area in which "Beano" may be conducted. See Maine Revised Statutes Title 17 Sec. 311

Machine: means any machine, including electronic devices, however operated, the internal mechanism or components of which when set in motion or activated and by the application of the element of chance may deliver or entitle the person playing or operating the machine to receive cash, premiums, merchandise, tickets or something of value as defined in subsection 17. See Maine Revised Statutes Title 17 Sec. 1831

Maine Rx Plus Program: means the Maine Rx Plus Program established under section 2681. See Maine Revised Statutes Title 22 Sec. 2685

MaineCare program: means the MaineCare program administered under chapter 855. See Maine Revised Statutes Title 22 Sec. 2685

Majority multiple-employer welfare arrangement: means the multiple-employer welfare arrangement, as defined in Title 24?A, section 6601, subsection 5, in which the majority of state municipal government employees are enrolled as of the effective date of this section. See Maine Revised Statutes Title 5 Sec. 286-M

Manufactured home: means a structure, transportable in one or more sections, that is 8 body feet or more in width and is 32 body feet or more in length and that is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning and electrical systems contained therein. See Maine Revised Statutes Title 10 Sec. 9081

Manufactured housing: means for the purpose of this subchapter, a structure, transportable in one or more sections, which, in the traveling mode, is 8 body feet or more in width, and 40 body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling, with or without a permanent foundation when connected to the required utilities, including the plumbing, heating, air-conditioning and electrical systems contained therein; except that the term shall include any structure which meets all the requirements of this subsection except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the Secretary of the United States Department of Housing and Urban Development and complies with the standards established under the National Manufactured Housing Construction and Safety Standards Act of 1974, 42 United States Code 5401, et seq. See Maine Revised Statutes Title 10 Sec. 9061

Manufactured housing: means a structural unit or units designed to be used as a dwelling or dwellings and constructed in a manufacturing facility and then transported by the use of its own chassis or placement on an independent chassis to a building site. See Maine Revised Statutes Title 10 Sec. 9002

Manufactured housing community: means a parcel or adjoining parcel of land, under single ownership, that has been planned and improved for the placement of 3 or more manufactured homes, but does not include a construction camp. See Maine Revised Statutes Title 10 Sec. 9081

Manufacturer: means a manufacturer of prescription drugs and includes a subsidiary or affiliate of a manufacturer. See Maine Revised Statutes Title 22 Sec. 2697

Manufacturer: means any person engaged in manufacturing or assembling manufactured homes, regardless of the destination of the homes, including any person engaged in importing homes for resale. See Maine Revised Statutes Title 10 Sec. 9061

Manufacturer: means any person engaged in manufacturing or producing manufactured housing and then selling it to a dealer. See Maine Revised Statutes Title 10 Sec. 9002

may: when used in this Title, is used in a permissive sense to grant authority or permission, but not to create duty, to act in the manner specified by the context. See Maine Revised Statutes Title 21-A Sec. 7

Mechanic: means an individual engaged in the installation or servicing of HUD-code or pre-HUD-code homes. See Maine Revised Statutes Title 10 Sec. 9002

Member: means a bona fide member of a firm, corporation, association, organization, department or class or a combination thereof who has been duly admitted as a member according to the laws, rules, regulations, ordinances or bylaws governing membership in the firm, corporation, association, organization, department, class or combination thereof. See Maine Revised Statutes Title 17 Sec. 311

Member: means a judge who is included in the membership of the Maine Judicial Retirement System as provided in section 1301. See Maine Revised Statutes Title 4 Sec. 1201

Membership service: means service rendered while a member of the Maine Judicial Retirement System for which credit is allowed under section 1302. See Maine Revised Statutes Title 4 Sec. 1201

Month: means a calendar month. See Maine Revised Statutes Title 1 Sec. 72

Mortgagee: The person to whom property is mortgaged and who has loaned the money.

Multiple community water district: means that area comprising all municipalities served in whole or part by a single public water system plus those public water system zones within multiservice municipalities served by the same public water system. See Maine Revised Statutes Title 22 Sec. 2651-A

Multiple community water system district-wide election: means an election held in each municipality within a multiple community water district to determine whether or not to fluoridate the water supply of that system. See Maine Revised Statutes Title 22 Sec. 2651-A

Multiservice municipality: means any municipality served in whole or in part by more than one public water system. See Maine Revised Statutes Title 22 Sec. 2651-A

Municipal committee: means a city, town or ward committee of a political party. See Maine Revised Statutes Title 21-A Sec. 1

Municipal firefighter: means a person employed by a municipal fire department with the primary responsibility of aiding in the extinguishment of fires and includes a member of emergency medical services line personnel but does not include a member of a volunteer firefighter association. See Maine Revised Statutes Title 5 Sec. 286-M

Municipal officers: means the mayor and aldermen or councillors of a city, the members of the select board or councillors of a town and the assessors of a plantation. See Maine Revised Statutes Title 21-A Sec. 1

Municipal officers: means the mayor and municipal officers or councilors of a city, the members of the select board or councilors of a town and the assessors of a plantation. See Maine Revised Statutes Title 1 Sec. 72

Municipality: means a city, town or plantation. See Maine Revised Statutes Title 22 Sec. 2651-A

Municipality: means a city, town or plantation. See Maine Revised Statutes Title 21-A Sec. 1

Municipality: includes cities, towns and plantations, except that "municipality" does not include plantations in Title 10, chapter 110, subchapter IV; or Title 30?A, Part 2. See Maine Revised Statutes Title 1 Sec. 72

Neglect: means a threat to an adult's health or welfare by physical or mental injury or impairment, deprivation of essential needs or lack of protection from these. See Maine Revised Statutes Title 22 Sec. 3472

Net revenue: means gross revenue less allowable expenses as described in section 1838. See Maine Revised Statutes Title 17 Sec. 1831

Noncommunity water system: means a public water system that is not a community water system. See Maine Revised Statutes Title 22 Sec. 2660-B

Nonpartisan staff: means the directors and staffs of the Office of Policy and Legal Analysis, the Office of Fiscal and Program Review, the Office of the Revisor of Statutes, the Legislative Information Office, the Law and Legislative Reference Library, the Office of Program Evaluation and Government Accountability, the Office of Legislative Information Technology and the Office of the Executive Director of the Legislative Council. See Maine Revised Statutes Title 5 Sec. 21

Oath: includes an affirmation, when affirmation is allowed. See Maine Revised Statutes Title 1 Sec. 72

Oath: A promise to tell the truth.

Online voter registration application: means the electronic voter registration application form created by the Secretary of State pursuant to section 152 and available on the Secretary of State's publicly accessible website and through which, in accordance with the rules adopted under section 152, subsection 6, an individual may register to vote and enroll in a party or a registered voter may enroll in a party, change the voter's party enrollment, withdraw from a party or notify the appropriate registrar of voters of a change in the voter's name or address when the voter's name is changed due to marriage or other process of law or when the voter has moved within a municipality. See Maine Revised Statutes Title 21-A Sec. 1

Organization: means any firm, association or corporation authorized to conduct "Beano" in accordance with this chapter. See Maine Revised Statutes Title 17 Sec. 311

Oversight: Committee review of the activities of a Federal agency or program.

Own time: means an employee's personal time or authorized leave time, earned as a condition of employment. See Maine Revised Statutes Title 5 Sec. 21

Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.

Party: means a political organization which has qualified to participate in a primary or general election under chapter 5. See Maine Revised Statutes Title 21-A Sec. 1

Period: means the number of calendar weeks authorized by a single license for the operation of "Beano" or "Bingo. See Maine Revised Statutes Title 17 Sec. 311

Permittee: means an individual, corporation, partnership or unincorporated association that rents or leases a building or facilities for profit to a licensee to hold, conduct or operate "beano. See Maine Revised Statutes Title 17 Sec. 311

Person: means any individual, partnership, company, public or private corporation, political subdivision or agency of the State, department, agency or instrumentality of the United States or any other legal entity. See Maine Revised Statutes Title 22 Sec. 2601

Person: means an individual or entity, including but not limited to a corporation, partnership, firm, organization, company, homeowner, consumer or purchaser. See Maine Revised Statutes Title 10 Sec. 9002

Personal property: All property that is not real property.

PFAS: means a perfluoroalkyl substance or polyfluoroalkyl substance that is detectable in drinking water using standard laboratory methods established by the United States Environmental Protection Agency, including regulated PFAS contaminants. See Maine Revised Statutes Title 22 Sec. 2660-AA

Plaintiff: The person who files the complaint in a civil lawsuit.

Population: means the population determined by the last Decennial Census of the United States. See Maine Revised Statutes Title 21-A Sec. 1

Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. ^{Source: OCC}

Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.

Primacy: means the federally delegated primary enforcement authority to adopt, implement and enforce federally mandated drinking water standards promulgated pursuant to the federal Safe Drinking Water Act as amended. See Maine Revised Statutes Title 22 Sec. 2660-B

Primary election: means the regular election for the election of nominees of a party for the general election. See Maine Revised Statutes Title 21-A Sec. 1

Prior service: means all service before December 1, 1984, as a judge. See Maine Revised Statutes Title 4 Sec. 1201

Probable cause: A reasonable ground for belief that the offender violated a specific law.

Probate: Proving a will

Program: means the Maine Public Drinking Water Control Program. See Maine Revised Statutes Title 22 Sec. 2660-B

Program: means the Retired County and Municipal Law Enforcement Officers and Municipal Firefighters Health Insurance Program established in this section. See Maine Revised Statutes Title 5 Sec. 286-M

Protective services: means services that separate incapacitated or dependent adults from danger. See Maine Revised Statutes Title 22 Sec. 3472

Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.

Public water system: means the public water agency, company, utility, district or other entity serving one or more municipalities in whole or in part. See Maine Revised Statutes Title 22 Sec. 2651-A

public water system: includes any collection, treatment, storage or distribution pipes or other constructed conveyances, structures or facilities under the control of the supplier of water and used primarily in connection with such a system, and any collection or pretreatment storage facilities not under that control that are used primarily in connection with such a system. See Maine Revised Statutes Title 22 Sec. 2601

Public water system zone: means any one of the 2 or more areas of a multiservice municipality served by a single public water system, as further defined in section 2657. See Maine Revised Statutes Title 22 Sec. 2651-A

Question: means any proposition submitted to the voters. See Maine Revised Statutes Title 21-A Sec. 1

Raffle: means a game of chance in which:

Real estate: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72

Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.

registered mail: when used in connection with any requirement for notice by mail shall mean either registered mail or certified mail. See Maine Revised Statutes Title 1 Sec. 72

Registered petitioners: means those registered voters residing in a single community water district or, in the case of a multiple community water system district-wide election, those registered voters residing in the multiple community water district who have accepted the responsibility of receiving notice concerning the filing of petitions pursuant to section 2655, subsection 3. See Maine Revised Statutes Title 22 Sec. 2651-A

Registrant: means a person or organization registered with the Gambling Control Unit to hold, conduct or operate beano games for which a license is not required. See Maine Revised Statutes Title 17 Sec. 311

Registrant: means a person or organization registered with the Gambling Control Unit to conduct a game of chance, a raffle or certain tournament games, for which a license is not required under this chapter. See Maine Revised Statutes Title 17 Sec. 1831

Registrar: means the registrar or deputy registrar of voters of a municipality. See Maine Revised Statutes Title 21-A Sec. 1

Regular interest: means interest at the rate which the Board of Trustees of the Maine Public Employees Retirement System sets from time to time, in accordance with Title 5, section 17156. See Maine Revised Statutes Title 4 Sec. 1201

Regulated PFAS contaminants: means perfluorooctanoic acid, perfluorooctane sulfonic acid, perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic acid and perfluorodecanoic acid. See Maine Revised Statutes Title 22 Sec. 2660-AA

Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.

Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).

Residence: means that place where the person has established a fixed and principal home to which the person, whenever temporarily absent, intends to return. See Maine Revised Statutes Title 21-A Sec. 1

Residence address: means the street and number or other designation indicating the physical location of a person's residence. See Maine Revised Statutes Title 21-A Sec. 1

retail pharmacy: means a retail pharmacy located in this State, or another business licensed to dispense prescription drugs in this State, that participates in the program. See Maine Revised Statutes Title 22 Sec. 2681

Retirement: means the termination of membership service with a retirement allowance granted under this chapter. See Maine Revised Statutes Title 4 Sec. 1201

Roulette: means a game of chance in which players bet on the compartment of a revolving wheel into which a small ball will come to rest. See Maine Revised Statutes Title 17 Sec. 1831

Secondary discounted price: means the initial discounted price minus any further discounts paid for out of the fund. See Maine Revised Statutes Title 22 Sec. 2681

Secretary: means the Secretary of the United States Department of Housing and Urban Development. See Maine Revised Statutes Title 10 Sec. 9061

Serious harm: means :

Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.

Sexual abuse or sexual exploitation: means contact or interaction of a sexual nature involving an incapacitated or dependent adult without that adult's informed consent. See Maine Revised Statutes Title 22 Sec. 3472

Signature: includes a signature stamp and a signature written by another registered voter on behalf of an individual in accordance with the procedure set forth in section 153?A and, for an individual who is unable to sign that individual's own name, a mark. See Maine Revised Statutes Title 21-A Sec. 1

Single community water district: means a municipality served in whole or in part by a water system which serves no other municipalities. See Maine Revised Statutes Title 22 Sec. 2651-A

Social gambling: means a contest of chance in which the only participants are players and from which no person or organization receives or becomes entitled to receive something of value or any profit whatsoever, directly or indirectly, other than as a player, from any source, fee, remuneration connected with gambling or such activity as arrangements or facilitation of the game, permitting the use of premises or selling or supplying for-profit refreshments, food, drink service or entertainment to participants, players or spectators. See Maine Revised Statutes Title 17 Sec. 1831

Something of value: means :

Spouse: means the person currently legally married to a member. See Maine Revised Statutes Title 4 Sec. 1201

State administrative agency: means the department that has been approved or conditionally approved to carry out the state plan for enforcement of the standards pursuant to section 623 of the Housing and Community Development Act of 1974, Public Law 93-383, 42 United States Code § 5422 and Title 24 of the Code of Federal Regulations, Part 3282, Subpart G. See Maine Revised Statutes Title 10 Sec. 9061

State employee: means any employee of an agency, independent agency or parts of agencies which receive support from the General Fund or that are established, created or incorporated by reference to the laws, except nonpartisan staff of the Legislature. See Maine Revised Statutes Title 5 Sec. 21

State employee health insurance program: means the state employee health insurance program provided under Title 5, section 285. See Maine Revised Statutes Title 22 Sec. 2685

Statute: A law passed by a legislature.

Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.

Subpoena: A command to a witness to appear and give testimony.

Summons: Another word for subpoena used by the criminal justice system.

Supervisor: means a commissioner, bureau chief, director, manager or any other person who oversees or supervises state employees in their employment. See Maine Revised Statutes Title 5 Sec. 21

Surviving spouse: means the spouse alive at the time of the death of the member or former member. See Maine Revised Statutes Title 4 Sec. 1201

Testify: Answer questions in court.

Testimony: Evidence presented orally by witnesses during trials or before grand juries.

Tokens: means distinctive objects, chips, tickets or other devices of no intrinsic value used as a substitute for cash in accounting for revenue from a game of chance. See Maine Revised Statutes Title 17 Sec. 1831

Town: includes cities and plantations, unless otherwise expressed or implied. See Maine Revised Statutes Title 1 Sec. 72

Township: means unorganized territory. See Maine Revised Statutes Title 21-A Sec. 1

Treasurer: means a person appointed by a candidate or a political committee to accept or disburse money to promote or defeat a candidate, party or principle. See Maine Revised Statutes Title 21-A Sec. 1

Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

Trustee: A person or institution holding and administering property in trust.

Undue influence: means the misuse of real or apparent authority or the use of manipulation by a person in a trusting, confidential or fiduciary relationship with a person who is a dependent adult or an incapacitated adult. See Maine Revised Statutes Title 22 Sec. 3472

unit: means the bureau within the Department of Public Safety under Title 25, section 2902, subsection 12 or an authorized representative of the Gambling Control Unit. See Maine Revised Statutes Title 17 Sec. 311

United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72

Verdict: The decision of a petit jury or a judge.

Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.

Victim advocate: work with prosecutors and assist the victims of a crime.

Voter: means a person registered to vote. See Maine Revised Statutes Title 21-A Sec. 1

Voting district: means an area set off from another in the same municipality for voting purposes. See Maine Revised Statutes Title 21-A Sec. 1

Voting place: means the building in which ballots are cast at an election. See Maine Revised Statutes Title 21-A Sec. 1

Warden: means the presiding officer at a voting place. See Maine Revised Statutes Title 21-A Sec. 1

Water treatment company: means a company that installs or services water treatment equipment. See Maine Revised Statutes Title 22 Sec. 2660-FF

Water treatment equipment: means equipment located inside a private residence and designed to alter the condition of water for human consumption, including by means of filtration, purification, softening and reverse osmosis. See Maine Revised Statutes Title 22 Sec. 2660-FF

Writ: A formal written command, issued from the court, requiring the performance of a specific act.

Write-in candidate: means a person whose name does not appear on the ballot under the office designation to which a voter may wish to elect the candidate. See Maine Revised Statutes Title 21-A Sec. 1

Year: means a calendar year, unless otherwise expressed. See Maine Revised Statutes Title 1 Sec. 72
