  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Architect: means the person or firm retained by the contracting agency to design the project to which the 1% provision of this chapter applies. See Maine Revised Statutes Title 27 Sec. 452
  • Arrest: Taking physical custody of a person by lawful authority.
  • Artist: means a practitioner in the arts, generally recognized as a professional by critics and peers, who produces works of art and who is not the architect or an employee of the architectural firm retained by the contracting agency. See Maine Revised Statutes Title 27 Sec. 452
  • Authority: means the Northern New England Passenger Rail Authority and any successors to that authority. See Maine Revised Statutes Title 23 Sec. 8002
  • Commission: means the Maine Arts Commission. See Maine Revised Statutes Title 27 Sec. 452
  • Commissioner: means the Commissioner of Public Safety. See Maine Revised Statutes Title 25 Sec. 2471
  • Construction: means the construction or renovation of a public building or public facility, the cost of which is at least $100,000, but does not include repairs or minor alterations. See Maine Revised Statutes Title 27 Sec. 452
  • Contract: A legal written agreement that becomes binding when signed.
  • Contracting agency: means the agency of State Government to which funds have been appropriated or allocated by the Legislature for the construction of any public building or other public facility. See Maine Revised Statutes Title 27 Sec. 452
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Explosive: means any chemical compound, mixture or device that is designed to function by explosion. See Maine Revised Statutes Title 25 Sec. 2471
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Magazine: means a specially constructed building or structure approved for the storage of explosive materials. See Maine Revised Statutes Title 25 Sec. 2471
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Permit: means the nontransferable permission granted by the commissioner containing one or more of the following endorsements: use, storage and intrastate transportation of explosives. See Maine Revised Statutes Title 25 Sec. 2471
  • Person: means any individual, partnership, corporation, combination of these entities or any other legal entity. See Maine Revised Statutes Title 25 Sec. 2471
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • public facility: includes only that part or those parts designed for the use of the public. See Maine Revised Statutes Title 27 Sec. 452
  • School construction project: means a project as defined in Title 20-A, section 15901, subsection 4. See Maine Revised Statutes Title 27 Sec. 452
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • Works of art: means any of the following original creations of art:
