Abutting land: means real estate that shares a common boundary, or portion of a boundary, with land that is held in common ownership with land registered or being considered for registration under this chapter when the abutting real estate is within 50 feet of the land registered or being considered for registration. accumulated contributions: includes as much of the employer's contribution in the Retirement Allowance Fund as is needed to reach 7. See Maine Revised Statutes Title 5 Sec. 17001
Acquisition: means fee ownership, easement, lease, right-of-way and other less-than-fee interests in land. See Maine Revised Statutes Title 12 Sec. 10301
Actuarial equivalent: means an amount of equal value when computed at the discount rate contained in actuarial assumptions adopted by the board. See Maine Revised Statutes Title 5 Sec. 17001
Actuary: means the individual or the organization designated by the board to be the technical advisor to the board under section 17107. See Maine Revised Statutes Title 5 Sec. 17001
Administrator: means the Administrator of the Office of Geographic Information Systems. See Maine Revised Statutes Title 5 Sec. 1991
Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
Affiliated business: means 2 businesses exhibiting either of the following relationships:

Affiliated group: means a qualified business and its corresponding affiliated businesses. See Maine Revised Statutes Title 5 Sec. 13080-P

Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.

Agency enforcement action: means an enforcement action initiated by an agency against a small business. See Maine Revised Statutes Title 5 Sec. 90-O

Agency of jurisdiction: means the state agency which has use of and jurisdiction over the facility. See Maine Revised Statutes Title 5 Sec. 1782

Agent: means a person or that person's representative who has been licensed under this chapter to sell lottery tickets on behalf of the State from the physical premises of the licensee's retail business establishment. See Maine Revised Statutes Title 8 Sec. 371

Agent: means an individual appointed to serve in the capacity of a superintendent. See Maine Revised Statutes Title 20-A Sec. 1

Agent: means any person who sells or distributes potatoes or rotation crops in commerce for or on behalf of producers or others and whose operations may include the planting, cultivating, harvesting, grading, packing and furnishing containers, supplies or other services. See Maine Revised Statutes Title 7 Sec. 1012

Aggrieved person: means any person who bids on a contract or grant and who is adversely affected, financially, professionally or personally, by that contract or grant award decision. See Maine Revised Statutes Title 5 Sec. 1825-A

Agreement: means any writing which is substantially prepared in advance of a consumer loan or consumer lease and which a supervised lender or lessor furnishes to a consumer for the consumer to sign in connection with that loan or lease. See Maine Revised Statutes Title 10 Sec. 1122

Agricultural chemicals: means fungicides, insecticides, herbicides, and other pesticides. See Maine Revised Statutes Title 7 Sec. 52

Agricultural society: means a nonprofit organization or association incorporated in the State to promote education and encourage improvement in agriculture. See Maine Revised Statutes Title 7 Sec. 81

Aircraft: means a machine or device designed for flight. See Maine Revised Statutes Title 12 Sec. 10001

Alternative education program: means a program in which the primary purpose is to provide at-risk students with curricula and assessment in a setting designed to effectively meet the student's academic, social and relational needs. See Maine Revised Statutes Title 20-A Sec. 1

Alternative learning: means an educational option that a public school or publicly supported program offers at-risk students by offering some combination of the following: alternative education programs; small class size; flexible scheduling; relevant alternative curricula and assessment; mentoring adults; skilled teachers; a focus on social, emotional and relationship skills; collaboration among home, school and social service agencies; and any other measures designed to accommodate the needs of at-risk students. Ambulance services: means those emergency services primarily designed to transport ill or injured persons to available medical facilities and to administer first aid and emergency life-support systems in the interim period. See Maine Revised Statutes Title 30-A Sec. 451

Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.

Amortization: Paying off a loan by regular installments.

Amount financed: means "amount financed" as defined by Title 9?A, section 1?301, subsection 5. See Maine Revised Statutes Title 10 Sec. 1122

Amusement owner: means a person, the State or a political subdivision of the State that owns an amusement ride or, if the amusement ride is leased, the lessee. See Maine Revised Statutes Title 8 Sec. 802

Amusement ride: means a device or combination of devices or elements that carry, convey or direct a person over or through a fixed or restricted course or within a defined area for the primary purpose of amusement or entertainment. See Maine Revised Statutes Title 8 Sec. 471

Amusement ride: means :

Amusement ride inspector: means an amusement ride inspector employed by the Office of the State Fire Marshal. See Maine Revised Statutes Title 8 Sec. 471

Amusement show: includes but is not limited to a carnival, thrill show, ice show and rodeo. See Maine Revised Statutes Title 8 Sec. 471

Animal: means an animal entered in an event. See Maine Revised Statutes Title 7 Sec. 81

Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.

Antlerless moose: means a moose without antlers. See Maine Revised Statutes Title 12 Sec. 10001

Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

Appeals board: means the State Civil Service Appeals Board. See Maine Revised Statutes Title 5 Sec. 7032

Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.

Applicant: means any person applying for a license under this Article. See Maine Revised Statutes Title 7 Sec. 1012

Application for credit: means any communication, oral or written, by a person to a creditor requesting an extension of credit to that person or to any other person, and includes any procedure involving the renewal or alteration of credit privileges or the changing of the name of the person to whom credit is extended;

Appointing authority: means the officer, board, commission, person or group of persons having the power by virtue of the Constitution of Maine, a statute or lawfully delegated authority to make appointments. See Maine Revised Statutes Title 5 Sec. 7032

Appraisal: A determination of property value.

Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization

Approved equal: means any goods or service other than specified in the bid proposal that in the opinion of the State Purchasing Agent is equivalent in character, quality and performance to the goods or service specified in the bid proposal. See Maine Revised Statutes Title 5 Sec. 1825-A

Approved private school: means a private school approved for attendance purposes under chapter 117. See Maine Revised Statutes Title 20-A Sec. 1

Aquarium: means an enclosed container used in importing, possessing or displaying nonnative and exotic species of fish or other aquatic organisms that has a closed operating system, that is located within a home, exhibition building or other permanent all-season structure and that does not allow the discharge of water or aquatic organisms into the inland waters of the State. See Maine Revised Statutes Title 12 Sec. 10001

Arborist: means a person who, for compensation, takes down or fells, diagnoses or evaluates the condition of shade or ornamental trees; solicits, recommends or supervises the treatment of those trees; or in any manner or for any purpose treats or cares for those trees. See Maine Revised Statutes Title 7 Sec. 2173

Archery equipment: means a bow or crossbow. See Maine Revised Statutes Title 12 Sec. 10001

Arrest: Taking physical custody of a person by lawful authority.

Article: means a product as distinguished from its trademark, label or distinctive dress in packaging;

Artificial lure: includes , but is not limited to, artificial flies, spinners, spoons, poppers, plugs, jigs and plastic, rubber or other artificial imitations of natural bait. See Maine Revised Statutes Title 12 Sec. 10001

Assessor: means the State Tax Assessor. See Maine Revised Statutes Title 5 Sec. 13080-P

Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.

Assets of the investment trust fund: means the funds appropriated or otherwise provided to fund the investment trust fund, together with the interest, earnings and returns on the funds. See Maine Revised Statutes Title 5 Sec. 17431

Association: means an organization:

Association: means any corporation organized under this chapter. See Maine Revised Statutes Title 13 Sec. 2003

ASTM standards: means standards for amusement rides established by American Society for Testing and Materials International or a successor organization and adopted by the commissioner by rule. See Maine Revised Statutes Title 8 Sec. 471

Atlantic salmon: means the anadromous fish species Salmo salar that customarily migrates from inland waters to the ocean as part of its life cycle. See Maine Revised Statutes Title 12 Sec. 10001

Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.

ATV grant coordinator: means the person retained by the commissioner to be responsible for providing administration and staff support for the ATV Enforcement Grant Program. See Maine Revised Statutes Title 12 Sec. 10321

Authority: means the Loring Development Authority of Maine. See Maine Revised Statutes Title 5 Sec. 13080-A

Authority: means the Loring Development Authority of Maine. See Maine Revised Statutes Title 5 Sec. 13080-P

Authority: means the Washington County Development Authority. See Maine Revised Statutes Title 5 Sec. 13083-B

Authority: means the Combat Sports Authority of Maine created under section 522. See Maine Revised Statutes Title 8 Sec. 521

Authority: means the Midcoast Regional Redevelopment Authority established in section 13083?G. See Maine Revised Statutes Title 5 Sec. 13083-H

Authorized participants: means competitors, officials, referees, judges, promoters, managers, physicians, timekeepers and knock-down timekeepers. See Maine Revised Statutes Title 8 Sec. 521

Autoloading firearm: means a firearm that reloads itself after each shot and requires that the trigger be pulled for each shot. See Maine Revised Statutes Title 12 Sec. 10001

Available facility: means a facility in which all or a part of the facility is unused and available for leasing. See Maine Revised Statutes Title 5 Sec. 1782

Average final compensation: means :

Average personal income growth: means the average for the prior 10 calendar years, ending with the most recent calendar year for which data is available, of the percent change in personal income in this State, as estimated by the United States Department of Commerce, Bureau of Economic Analysis. Baitfish: means only those species in the following list:

Baitfish trap: means a device used to take baitfish fitted with rigid entrance or exit holes and having a volume no greater than 50 cubic feet. See Maine Revised Statutes Title 12 Sec. 10001

Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.

base: means those properties and facilities within the geographic boundaries of the United States Department of Defense air force base at Limestone existing on July 13, 1993. See Maine Revised Statutes Title 5 Sec. 13080-A

base: means those properties and facilities within the geographic boundaries of the United States Department of Defense naval air station at Brunswick existing on the effective date of this section. See Maine Revised Statutes Title 5 Sec. 13083-H

Base area: means the area within the geographic boundaries of Loring Air Force Base. See Maine Revised Statutes Title 5 Sec. 13080-A

Base area: means the area within the geographic boundaries of Loring Air Force Base, as defined in section 13080?A. See Maine Revised Statutes Title 5 Sec. 13080-P

Base area: means the area within the geographical boundaries of any decommissioned federal military facility located within Washington County to which the authority has taken title. See Maine Revised Statutes Title 5 Sec. 13083-B

Base area: means the area within the geographic boundaries of Brunswick Naval Air Station. See Maine Revised Statutes Title 5 Sec. 13083-H

Base level of employment: means the total employment in the base area as of July 1, 1996. See Maine Revised Statutes Title 5 Sec. 13080-P

Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.

Bear bait: means an animal or plant or derivative of an animal or plant used to attract bear. See Maine Revised Statutes Title 12 Sec. 10001

Beneficiary: means a person or persons designated by a member to receive a benefit under this Part or a person otherwise entitled to receive a benefit under this Part. See Maine Revised Statutes Title 5 Sec. 17001

Benefit: means any payment made, or required to be made, to a beneficiary under chapter 423, subchapter V or chapter 425, subchapter V. See Maine Revised Statutes Title 5 Sec. 17001

Bequest: Property gifted by will.

Biennial base year appropriation: means :

Billing period: means the time period for payment agreed to by 2 parties or, in the absence of an agreement, the calendar month within which work is performed. See Maine Revised Statutes Title 10 Sec. 1111

Board: means the board of directors of the authority. See Maine Revised Statutes Title 8 Sec. 521

Board: means the board of trustees, established under section 12004?F, subsection 9, to administer the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001

Board: means the Maine Potato Board established in Title 36, section 4603. See Maine Revised Statutes Title 7 Sec. 970

Board: means the Maine Outdoor Heritage Fund Board established in section 10308. See Maine Revised Statutes Title 12 Sec. 10301

Board: means the Small Enterprise Growth Board. See Maine Revised Statutes Title 10 Sec. 382

Board of directors: means the governing body with statutory powers and duties for a school administrative district. See Maine Revised Statutes Title 20-A Sec. 1

Board of trustees: means the Maine Rural Development Authority Board of Trustees. See Maine Revised Statutes Title 5 Sec. 13120-B

Bond: means a bond or note or other evidence of indebtedness authorized under this article, whether issued under or pursuant to a bond resolution, trust indenture, loan or other security agreement. See Maine Revised Statutes Title 5 Sec. 13080-A

Bonds: means any bonds, notes, interim certificates, debentures or other obligations issued by an authority under this chapter. See Maine Revised Statutes Title 30-A Sec. 4702

Boundary waters between Maine and New Brunswick: means :

bow: includes a compound bow, a recurve bow and a long bow. See Maine Revised Statutes Title 12 Sec. 10001

Boxing: means a combative sport for compensation that features the use of gloved fists in attack and defense. See Maine Revised Statutes Title 8 Sec. 521

Broker: means any person engaged in the business of negotiating sales of potatoes in commerce for or on behalf of the seller or the purchaser, respectively. See Maine Revised Statutes Title 7 Sec. 1012

Bureau: means the Bureau of Alcoholic Beverages and Lottery Operations within the Department of Administrative and Financial Services to carry out the purposes of this chapter. See Maine Revised Statutes Title 8 Sec. 371

Business concern: means a person, partnership or corporation engaged in providing property, products or services for the purpose of gain, benefit or advantage, either direct or indirect, whether or not the concern is organized for profit or not for profit. See Maine Revised Statutes Title 5 Sec. 1552

Buyer: means any person other than a consumer who purchases or contracts to purchase potatoes or rotation crops. See Maine Revised Statutes Title 7 Sec. 1012

Carrying costs: means reasonable costs incurred for the maintenance, protection and security of a speculative industrial building prior to occupancy, including, but not limited to, insurance, taxes and interest. See Maine Revised Statutes Title 5 Sec. 13120-B

Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.

Certification mark: means a mark used in connection with the goods or services of a person other than the certifier to indicate geographic origin, material, mode of manufacture, quality, accuracy or other characteristics of the goods or services or to indicate that the work or labor on the goods or services was performed by members of a union or other organization;

certified seed: as used in this Title shall be deemed to mean potato, vegetable, forage crop or grain seeds as shall have been grown and prepared for sale in accordance with regulations laid down by the commissioner and for which a certificate or tag has been issued as provided in section 2103. Chief executive officer: means the Chief Executive Officer of the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001

Chief Information Officer: means the person who holds the lead information technology position within the executive branch that directs, coordinates and oversees information technology policy making, planning, architecture and standardization. See Maine Revised Statutes Title 5 Sec. 1972

Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.

Child: means any natural or legally adopted, born or unborn, progeny of a member. See Maine Revised Statutes Title 5 Sec. 17001

Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72

Civil deputy: means a deputy who meets the requirements for a civil deputy adopted by the sheriff and has been designated by the sheriff to enforce civil laws and serve civil process. See Maine Revised Statutes Title 30-A Sec. 351

Classified service: means all offices and positions of trust and employment in state service, except those placed in the unclassified service by chapter 71. See Maine Revised Statutes Title 5 Sec. 7032

Code of conduct: means the state purchasing code of conduct that follows the principles set out in section 1825?L. See Maine Revised Statutes Title 5 Sec. 1825-K

Collective mark: means a mark used by members of a cooperative, association or other collective group or organization to identify goods or services and distinguish them from those of others, or to indicate membership in the collective group or organization;

Commercial: means related to or connected with the furtherance of a profit-making enterprise. See Maine Revised Statutes Title 5 Sec. 13120-B

Commercial facility: means real estate and improvements used principally for commercial purposes or suitable for commercial use. See Maine Revised Statutes Title 5 Sec. 13120-B

Commercial farming: means the production of any farm product with the intent that that farm product be sold or otherwise disposed of to generate income. See Maine Revised Statutes Title 7 Sec. 52

Commercial meet: means harness horse racing conducted live at a commercial track. See Maine Revised Statutes Title 8 Sec. 275-A

Commercial track: means any harness horse racing track that is a for-profit business and is licensed under this chapter to conduct harness horse racing with pari-mutuel wagering that is not associated with an agricultural fair as defined in Title 7, section 81 and that:
