Terms Used In Maryland Code, COMMERCIAL LAW 11-1605

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. (a) In addition to any action by the Division or Attorney General authorized by Title 13 of this article, a target may bring an action in an appropriate court to recover for injury or loss sustained as a result of a violation of this subtitle.

(b) If a target prevails in an action brought under this subtitle and is awarded damages, the court also may award:

(1) Court costs and fees, including reasonable attorney’s fees;

(2) Exemplary damages in an amount not to exceed the greater of:

(i) $50,000; or

(ii) Three times the total of damages, costs, and fees; and

(3) Any equitable relief that the court considers appropriate.
