  • Adjusted household income: means that term as defined in R 125. See Michigan Laws 207.902
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Apprentice plumber: means an individual who is registered under this article as an apprentice. See Michigan Laws 339.6101
  • Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as a part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 339.5103
  • Attainable housing property: means that portion of real property not occupied by an owner of that real property of not more than 4 units that is classified as residential real property under section 34c of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902
  • Board: means the state plumbing board described in section 1105. See Michigan Laws 339.6101
  • Building sewer: means that part of the drainage system that extends from the end of the building drain and conveys its discharge to a public sewer, private sewer, individual sewage disposal system, or other point of disposal. See Michigan Laws 339.6101
  • certificate: means the certificate issued under section 6. See Michigan Laws 207.902
  • Charitable organization: means a not-for-profit tax-exempt religious, educational, or humane organization. See Michigan Laws 339.5103
  • Commission: means the state construction code commission created in section 3a of the Stille-DeRossett-Hale single state construction code act, 1972 PA 230, MCL 125. See Michigan Laws 339.6001
  • Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.902
  • Completed application: means an application that is complete on its face and submitted with any applicable licensing or permit fees and any other information, records, approval, security, or similar item required by law or rule from a local unit of government, a federal agency, or a private entity but not from another department or agency of this state. See Michigan Laws 339.5103
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of treasury. See Michigan Laws 207.902
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103
  • Director: means the director of the department of licensing and regulatory affairs or his or her authorized representative. See Michigan Laws 339.5103
  • district: means an area in a qualified local governmental unit established as provided in section 3 in which attainable housing property is or will be located. See Michigan Laws 207.902
  • Domestic water treatment and filtering equipment: means residential water treatment and filtering equipment used in 1-family and 2-family dwellings. See Michigan Laws 339.6101
  • Enforcing agency: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
  • Ex officio: Literally, by virtue of one's office.
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105
  • Governmental subdivision: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance.   • Income-qualified household: means an individual, couple, family, or group of unrelated individuals whose adjusted household income is 120% or less of the countywide area median income as posted annually by the Michigan state housing development authority on its website. See Michigan Laws 207.902
  • Inspector: means the individual who is responsible for the administration and enforcement of the construction of buildings, structures, or appurtenances under the state construction code. See Michigan Laws 339.6003
  • Journey plumber: means an individual, other than a plumbing contractor or master plumber, who is qualified to engage in the practical installation of plumbing and who is licensed as a journey plumber. See Michigan Laws 339.6101
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105
  • Licensee: means a person that is issued a license under this act. See Michigan Laws 339.5105
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Master plumber: means an individual who possesses the necessary skills and qualifications to plan and supervise the installation of plumbing and who is licensed as a master plumber. See Michigan Laws 339.6103
  • Minor repair: means a repair that involves only the clearance of stoppages, repair, or replacement of a faucet or valve or reinstallation of that same plumbing fixture and does not involve making any modifications to the plumbing system, or residential domestic water treatment and filtering equipment. See Michigan Laws 339.6103
  • Modified household income: means the gross annual income from all sources and before taxes or withholding of all individuals of a household living in a residential dwelling unit or housing unit after deducting all of the following:
  (i) Unusual or temporary income of any member of the household. See Michigan Laws 207.902
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • New facility: means attainable housing property newly constructed on or after the effective date of this act. See Michigan Laws 207.902
  • Occupation: means a field of endeavor regulated under this act. See Michigan Laws 339.5107
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107
  • Plumbing: means the practice, materials, and fixtures, in or adjacent to a building, structure, or premises, used in the installation, maintenance, extension, or alteration of all piping, fixtures, plumbing appliances, or plumbing appurtenances, as defined in the state construction code, in connection with the sanitary drainage or storm drainage facilities, plumbing venting systems, medical gas systems, backflow preventers, and public or private water supply systems.   • Plumbing contractor: means a licensed master plumber or a person who employs a licensed master plumber full-time to directly supervise the installation of plumbing as his or her representative engaged in the business of plumbing for a fixed sum, price, fee percentage, valuable consideration, or other compensation and who is licensed as a plumbing contractor. See Michigan Laws 339.6103
  • Qualified facility: means a new facility or a rehabilitated facility, located in an attainable housing district. See Michigan Laws 207.902
  • Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.902
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Rehabilitated facility: means existing attainable housing property that has been renovated, with a renovation investment of not less than $5,000. See Michigan Laws 207.902
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rule: means a rule promulgated under the administrative procedures act of 1969. See Michigan Laws 339.5107
  • specific tax: means the specific tax levied under this act. See Michigan Laws 207.902
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107
  • Stille-DeRossett-Hale single state construction code act: means 1972 PA 230, MCL 125. See Michigan Laws 339.5107
  • Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Water service pipe: means the pipe from the water main or other source of potable water supply to the water distributing system of the building served. See Michigan Laws 339.6103
