  • Council: the state oil and gas council established by section 259. See Missouri Laws 259.050
  • Gas: all natural gas and all other fluid hydrocarbons which are produced at the wellhead and not hereinbelow defined as oil. See Missouri Laws 259.050
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Oil: crude petroleum oil and other hydrocarbons regardless of gravity which are produced at the wellhead in liquid form and the liquid hydrocarbons known as distillate or condensate recovered or extracted from gas, other than gas produced in association with oil and commonly known as casinghead gas.   • State: when applied to any of the United States, includes the District of Columbia and the territories, and the words "United States" includes such district and territories. See Missouri Laws 1.020

The state, counties, cities and towns and other political subdivisions are hereby authorized to lease publicly owned lands under their respective jurisdictions for the purpose of oil or gas exploration and production. No such lease shall be entered into until it has been approved by the general assembly on behalf of the state; on behalf of counties by the county commission; on behalf of cities and towns by the council thereof and on behalf of other political subdivisions by the governing body thereof. Such leases shall be upon such terms and conditions as may be agreed upon. All revenue derived from the leasing of state owned lands shall be paid into the general fund of the state. All revenue derived from the leasing of other public lands shall be paid into the general fund of the respective lessor political subdivision.
